1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to statistical reporting by aquatic products dealers.
1-22 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-23 SECTION 1. Sections 66.019(b), (c), and (d), Parks and
1-24 Wildlife Code, are amended to read as follows:
1-25 (b) The department shall prescribe the method or methods
1-26 used to gather information and shall<,> produce<,> and distribute
1-27 any applicable <the> report forms <form>. <The form shall be
1-28 designed to allow for statistical information concerning the
1-29 numbers and quantity by weight of each species taken, the kinds of
1-30 equipment used to take each species, and the name of the body of
1-31 water from which each species was taken.>
1-32 (c) Unless otherwise required by the department, no <No>
1-33 dealer who purchases or receives aquatic products directly from any
1-34 person other than a licensed dealer may fail to file the report
1-35 with the department each month on or before the 10th day of the
1-36 month following the month in which the reportable activity
1-37 occurred. The report must be filed even if no reportable activity
1-38 occurs in the month covered by the report. No dealer required to
1-39 report may file an incorrect or false report. A culpable mental
1-40 state is not required to establish an offense under this section.
1-41 (d) Unless otherwise required by the department, no <No>
1-42 dealer who purchases, receives, or handles aquatic products, other
1-43 than oysters, from any person except another dealer may fail to:
1-44 (1) maintain cash sale tickets in the form required by
1-45 this section as records of cash sale transactions; or
1-46 (2) make the cash sale tickets available for
1-47 examination by authorized employees of the department for
1-48 statistical purposes or as a part of an ongoing investigation of a
1-49 criminal violation during reasonable business hours of the dealer.
1-50 SECTION 2. This Act takes effect September 1, 1993.
1-51 SECTION 3. The importance of this legislation and the
1-52 crowded condition of the calendars in both houses create an
1-53 emergency and an imperative public necessity that the
1-54 constitutional rule requiring bills to be read on three several
1-55 days in each house be suspended, and this rule is hereby suspended.
