                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to use of social security numbers of driver's license
    1-3  applicants to assist in child support enforcement.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 6, Chapter 173, Acts of the 47th
    1-6  Legislature, Regular Session, 1941 (Article 6687b, Vernon's Texas
    1-7  Civil Statutes), is amended by adding Subsection (j) to read as
    1-8  follows:
    1-9        (j)  An application for an original or renewal driver's
   1-10  license must include the applicant's social security number
   1-11  verified by presentation of the applicant's social security card.
   1-12        SECTION 2.  Chapter 173, Acts of the 47th Legislature,
   1-13  Regular Session, 1941 (Article 6687b, Vernon's Texas Civil
   1-14  Statutes), is amended by adding Section 6A to read as follows:
   1-15        Sec. 6A.  USE OF INFORMATION RELATING TO APPLICANT'S SOCIAL
   1-16  SECURITY NUMBER.  (a)  Information on a driver's license
   1-17  application relating to the applicant's social security number may
   1-18  be released to or used only by the Department, the child support
   1-19  enforcement division of the attorney general's office, or another
   1-20  entity responsible for enforcing the payment of child support.
   1-21        (b)  The Department shall enter an applicant's social
   1-22  security number in the Department's electronic data base but may
   1-23  not print the number on the applicant's driver's license.
   1-24        (c)  On request of an entity responsible for investigating or
    2-1  enforcing the payment of child support, the Department shall
    2-2  provide information regarding an applicant's social security
    2-3  number.
    2-4        (d)  Information made available under this section may be
    2-5  used by the child support enforcement division of the attorney
    2-6  general's office, or another entity responsible for enforcing the
    2-7  payment of child support, only to carry out its duties.
    2-8        SECTION 3.  The Texas Commercial Driver's License Act
    2-9  (Article 6687b-2, Revised Statutes) is amended by adding Section
   2-10  18A to read as follows:
   2-11        Sec. 18A.  RELEASE OF APPLICANT'S SOCIAL SECURITY NUMBER FOR
   2-12  CHILD SUPPORT ENFORCEMENT.  (a)  Information on a driver's license
   2-13  application relating to the applicant's social security number may
   2-14  be released to or used only by the Department, the child support
   2-15  enforcement division of the attorney general's office, or another
   2-16  entity responsible for enforcing the payment of child support.
   2-17        (b)  The Department shall enter an applicant's social
   2-18  security number in the Department's electronic data base but may
   2-19  not print the number on the applicant's driver's license.
   2-20        (c)  On request of an entity responsible for investigating or
   2-21  enforcing the payment of child support, the Department shall
   2-22  provide information regarding the social security number of an
   2-23  applicant for a commercial driver's license.
   2-24        (d)  Information made available under this section may be
   2-25  used by the child support enforcement division of the attorney
   2-26  general's office, or another entity responsible for enforcing the
   2-27  payment of child support, only to carry out its duties.
    3-1        SECTION 4.  This Act takes effect September 1, 1993, and
    3-2  applies only to a license or license renewal under Chapter 173,
    3-3  Acts of the 47th Legislature, Regular Session, 1941 (Article 6687b,
    3-4  Vernon's Texas Civil Statutes), or the Texas Commercial Driver's
    3-5  License Act (Article 6687b-2, Revised Statutes), for which
    3-6  application is made on or after the Act's effective date.  A
    3-7  license or license renewal for which application is made before the
    3-8  Act's effective date is subject to the law then in effect and the
    3-9  former law is continued in effect for that purpose.
   3-10        SECTION 5.  The importance of this legislation and the
   3-11  crowded condition of the calendars in both houses create an
   3-12  emergency and an imperative public necessity that the
   3-13  constitutional rule requiring bills to be read on three several
   3-14  days in each house be suspended, and this rule is hereby suspended.

   3-17        Replace "must" from page 1, line 10 with "may".
   3-18        Strike "verified by presentation of the applicant's social
   3-19  security card" from page 1, line 11.
   3-20        Strike "only" from page 1, line 18.
   3-21        Strike "only" from page 2, line 14.
