   1-41                                AN ACT
   1-42  relating to use of social security numbers of driver's license
   1-43  applicants to assist in child support enforcement.
   1-44        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-45        SECTION 1.  Chapter 173, Acts of the 47th Legislature,
   1-46  Regular Session, 1941 (Article 6687b, Vernon's Texas Civil
   1-47  Statutes), is amended by adding Section 6A to read as follows:
   1-48        Sec. 6A.  USE OF INFORMATION RELATING TO APPLICANT'S SOCIAL
   1-49  SECURITY NUMBER.  (a)  Information on a driver's license
   1-50  application relating to the applicant's social security number may
   1-51  be released to or used by the Department, the child support
   1-52  enforcement division of the attorney general's office, or another
   1-53  state entity responsible for enforcing the payment of child
   1-54  support.
   1-55        (b)  The Department shall enter an applicant's social
   1-56  security number in the Department's electronic data base but may
   1-57  not print the number on the applicant's driver's license.
   1-58        (c)  On request of a state entity responsible for
   1-59  investigating or enforcing the payment of child support, the
   1-60  Department shall provide information regarding an applicant's
   1-61  social security number.
   1-62        (d)  Information made available under this section may be
   1-63  used by the child support enforcement division of the attorney
   1-64  general's office, or another state entity responsible for enforcing
   1-65  the payment of child support, only to carry out its duties.
   1-66        SECTION 2.  The Texas Commercial Driver's License Act
   1-67  (Article 6687b-2, Revised Statutes) is amended by adding Section
   1-68  18A to read as follows:
    2-1        Sec. 18A.  RELEASE OF APPLICANT'S SOCIAL SECURITY NUMBER FOR
    2-2  CHILD SUPPORT ENFORCEMENT.  (a)  Information on a driver's license
    2-3  application relating to the applicant's social security number may
    2-4  be released to or used by the Department, the child support
    2-5  enforcement division of the attorney general's office, or another
    2-6  state entity responsible for enforcing the payment of child
    2-7  support.
    2-8        (b)  The Department shall enter an applicant's social
    2-9  security number in the Department's electronic data base but may
   2-10  not print the number on the applicant's driver's license.
   2-11        (c)  On request of a state entity responsible for
   2-12  investigating or enforcing the payment of child support, the
   2-13  Department shall provide information regarding the social security
   2-14  number of an applicant for a commercial driver's license.
   2-15        (d)  Information made available under this section may be
   2-16  used by the child support enforcement division of the attorney
   2-17  general's office, or another state entity responsible for enforcing
   2-18  the payment of child support, only to carry out its duties.
   2-19        SECTION 3.  This Act takes effect September 1, 1993, and
   2-20  applies only to a license or license renewal under Chapter 173,
   2-21  Acts of the 47th Legislature, Regular Session, 1941 (Article 6687b,
   2-22  Vernon's Texas Civil Statutes), or the Texas Commercial Driver's
   2-23  License Act (Article 6687b-2, Revised Statutes), for which
   2-24  application is made on or after the Act's effective date.  A
   2-25  license or license renewal for which application is made before the
   2-26  Act's effective date is subject to the law then in effect and the
   2-27  former law is continued in effect for that purpose.
   2-28        SECTION 4.  The importance of this legislation and the
   2-29  crowded condition of the calendars in both houses create an
   2-30  emergency and an imperative public necessity that the
   2-31  constitutional rule requiring bills to be read on three several
   2-32  days in each house be suspended, and this rule is hereby suspended.
