                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to assignment and docketing of civil cases in the 49th
    1-3  District Court.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 24.151(f), Government Code, is amended to
    1-6  read as follows:
    1-7        (f)  In Webb County, the clerk of the district courts shall
    1-8  file all civil cases, except tax suits, on the Clerk's Civil File
    1-9  Docket and shall number the cases consecutively.  Each civil case,
   1-10  except tax suits, shall be assigned and docketed at random by the
   1-11  district clerk <in the court designated by the attorney filing the
   1-12  case>.  The clerk shall keep a separate file docket, known as the
   1-13  Clerk's Criminal File Docket, for criminal cases and a separate
   1-14  file docket, known as the Clerk's Tax Suit Docket, for tax suits.
   1-15  Each criminal case and tax suit shall be assigned and docketed in
   1-16  the 49th District Court.  The clerk shall number the cases on the
   1-17  Clerk's Tax Suit Docket consecutively with a separate series of
   1-18  numbers and shall number the cases on the Clerk's Criminal File
   1-19  Docket consecutively with a separate series of numbers.
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended.

    2-2        Amends House Bill 1180 as follows:
    2-3        (1)  On page 1, line 9, between "civil" and "case" insert
    2-4  "and criminal".
    2-5        (2)  On page 1, line 15 by striking "criminal case and" and
    2-6  inserting "<criminal case and>".
