                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the termination of the teacher career ladder.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  The following provisions of the Education Code
    1-5  are repealed:
    1-6              (1)  Subchapter E, Chapter 13; and
    1-7              (2)  Sections 13.0321(c), 13.035(c), 16.057, and
    1-8  16.158.
    1-9        SECTION 2.  Section 16.202, Education Code, is amended to
   1-10  read as follows:
   1-11        Sec. 16.202.  Studies.  On a biennial basis, the Legislative
   1-12  Education Board and the Legislative Budget Board, with the
   1-13  assistance of the Educational Economic Policy Center and the
   1-14  Central Education Agency, shall complete each of the following
   1-15  studies and develop recommended amounts where appropriate for each
   1-16  year of the next biennium:
   1-17              (1)  a study of the fiscal neutrality of the system to
   1-18  determine the status of the state and local finance system with
   1-19  regard to the policies established under the provisions of Section
   1-20  16.001 of this code, including recommendations for adjustments
   1-21  necessary to maintain fiscal neutrality;
   1-22              (2)  the accountable costs per student to school
   1-23  districts of providing educational programs, personnel, and other
   1-24  operating costs that meet accreditation criteria and the provisions
    2-1  of law and regulation;
    2-2              (3)  program cost differentials designed by program to
    2-3  provide support for the added expense of high-cost courses or
    2-4  programs for students participating in such courses or programs,
    2-5  with the program funding level expressed as dollar amounts and as
    2-6  weights applied to the adjusted basic allotment for the appropriate
    2-7  year;
    2-8              (4)  transportation allotment <and career ladder
    2-9  allotments>;
   2-10              (5)  the levels of tax effort necessary for each tier
   2-11  of the Foundation School Program necessary to fulfill the
   2-12  requirements of Sections 16.001 and 16.008 of this code; and
   2-13              (6)  capital outlay and debt service requirements and
   2-14  formula elements for the requirements of Subchapter I of this
   2-15  chapter or other provisions of this chapter.
   2-16        SECTION 3.  Section 16.302(a), Education Code, is amended to
   2-17  read as follows:
   2-18        (a)  Each school district is guaranteed a specified amount
   2-19  per weighted student in state and local funds for each cent of tax
   2-20  effort over that required for the local fund assignment of the
   2-21  county education district in which the school district is located
   2-22  up to the maximum level specified in this subchapter.  The amount
   2-23  of state support, subject only to the maximum amount under Section
   2-24  16.303 of this code, is determined by the formula:
   2-25  where:
   2-26        "GYA" is the guaranteed yield amount of state funds to be
   2-27  allocated to the district;
    3-1        "GL" is the dollar amount guaranteed level of state and local
    3-2  funds per weighted student per cent of tax effort, which is $21.50
    3-3  for the 1991-1992 school year, $22.50 for the 1992-1993 school
    3-4  year, $26 for the 1993-1994 school year, and $28 for each school
    3-5  year thereafter, or a greater amount for any year provided by
    3-6  appropriation, or a greater amount adopted by the foundation school
    3-7  fund budget committee under Section 16.256(d) of this code for the
    3-8  1993-1994 or 1994-1995 school year or thereafter;
    3-9        "WADA", except as provided by Section 16.206 of this code, is
   3-10  the number of weighted students in average daily attendance, which
   3-11  is calculated by dividing the sum of the school district's
   3-12  allotments under Subchapters C and D of this chapter, less any
   3-13  allotments to the district for transportation<, career ladder
   3-14  supplements,> or technology and 50 percent of the  adjustment under
   3-15  Section 16.102 of this code, by the basic allotment for the
   3-16  applicable year;
   3-17        "DTR" is the district enrichment and facilities tax rate of
   3-18  the school district, which is determined by dividing the total
   3-19  amount of taxes collected by the school district for the applicable
   3-20  school year by the quotient of the district's taxable value of
   3-21  property as determined under Section 11.86 of this code divided by
   3-22  100; and
   3-23        "LR" is the local revenue, which is determined by multiplying
   3-24  "DTR" by the quotient of the district's taxable value of property
   3-25  as determined under Section 11.86 of this code divided by 100.
   3-26        SECTION 4.  Section 13.912(a), Education Code, is amended to
   3-27  read as follows:
    4-1        (a)  A school district may not deny a teacher a salary bonus
    4-2  or similar compensation given in whole or in part on the basis of
    4-3  teacher attendance <or a career ladder advancement> because of the
    4-4  teacher's absence from school for observance of a religious holy
    4-5  day.
    4-6        SECTION 5.  Section 825.405(b), Government Code, is amended
    4-7  to read as follows:
    4-8        (b)  For purposes of this section, the statutory minimum
    4-9  salary is the salary provided by Section 16.056, Education Code,
   4-10  multiplied by the cost of education adjustment applicable under
   4-11  Section 16.102, Education Code, to the district in which the member
   4-12  is employed<, plus any career ladder supplement under Section
   4-13  16.057, Education Code>.
   4-14        SECTION 6.  This Act takes effect September 1, 1993.
   4-15        SECTION 7.  A teacher employed by a school district for the
   4-16  1992-1993 school year and receiving a career ladder supplement is
   4-17  entitled to receive a salary in the 1993-1994 school year and each
   4-18  year thereafter in an amount that is equal to or greater than the
   4-19  sum of the teacher's salary and career ladder supplement for the
   4-20  1992-1993 school year if the teacher remains employed by that
   4-21  school district in the same or a similar position.
   4-22        SECTION 8.  The importance of this legislation and the
   4-23  crowded condition of the calendars in both houses create an
   4-24  emergency and an imperative public necessity that the
   4-25  constitutional rule requiring bills to be read on three several
   4-26  days in each house be suspended, and this rule is hereby suspended.
