1-23 A BILL TO BE ENTITLED
1-24 AN ACT
1-25 relating to installment payments of ad valorem taxes imposed on the
1-26 homestead of an elderly person.
1-27 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-28 SECTION 1. Section 31.031(a), Tax Code, is amended to read
1-29 as follows:
1-30 (a) If before the delinquency date an individual who is at
1-31 least 65 years of age claims the elderly homestead exemption and
1-32 pays at least one-fourth of a taxing unit's taxes imposed on
1-33 property that the person owns and occupies as a residence
1-34 homestead, accompanied by notice to the taxing unit that the person
1-35 will pay the remaining taxes in installments, the person may pay
1-36 the remaining taxes without penalty or interest in three equal
1-37 installments. The first installment must be paid before April 1,
1-38 the second installment before June 1, and the third installment
1-39 before August 1.
1-40 SECTION 2. This Act takes effect September 1, 1993.
1-41 SECTION 3. The importance of this legislation and the
1-42 crowded condition of the calendars in both houses create an
1-43 emergency and an imperative public necessity that the
1-44 constitutional rule requiring bills to be read on three several
1-45 days in each house be suspended, and this rule is hereby suspended.
