                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the enforcement of certain agreements between the
    1-3  parties to a marriage.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 5.46, Family Code, is amended by adding
    1-6  Subsection (c) to read as follows:
    1-7        (c)  The remedies and defenses in this section are exclusive
    1-8  of any other remedies or defenses, including common law remedies or
    1-9  defenses.
   1-10        SECTION 2.  Section 5.55, Family Code, is amended by adding
   1-11  Subsection (c) to read as follows:
   1-12        (c)  The remedies and defenses in this section are exclusive
   1-13  of any other remedies or defenses, including common law remedies or
   1-14  defenses.
   1-15        SECTION 3.  This Act takes effect September 1, 1993, and
   1-16  applies only to an agreement executed on or after that date.  An
   1-17  agreement executed before that date is governed by the law in
   1-18  effect at the time the agreement was executed, and the former law
   1-19  is continued in effect for that purpose.
   1-20        SECTION 4.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended.
