A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the creation of the housing for the homeless fund
1-3 within the Texas Department of Housing and Community Affairs.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Part 3, Article 4413(501), Revised Statutes, is
1-6 amended by adding Section 3.16A to read as follows:
1-7 Sec. 3.16A. HOUSING FOR THE HOMELESS FUND. (a) In this
1-8 section, "fund" means the housing for the homeless fund.
1-9 (b) The housing for the homeless fund is created in the
1-10 state treasury. Money in the fund may be appropriated only to
1-11 provide grants to municipalities and counties to construct and
1-12 equip facilities for the homeless.
1-13 (c) The proceeds of bonds issued under Section 3.24(i) of
1-14 this article shall be deposited in the housing for the homeless
1-15 fund.
1-16 (d) A municipality or county may apply to the agency for a
1-17 grant from proceeds from bonds issued under Section 3.24(i) of this
1-18 article. The agency by rule shall establish procedures to apply
1-19 for a grant under this section.
1-20 (e) A municipality or county may contract with a private
1-21 nonprofit corporation, as defined by the Texas Non-Profit
1-22 Corporation Act (Article 1396-1.01 et seq., Vernon's Texas Civil
1-23 Statutes), to operate a facility constructed or equipped by a grant
1-24 under this section.
2-1 SECTION 2. Section 3.24, Article 4413(501), Revised
2-2 Statutes, is amended by adding Subsection (i) to read as follows:
2-3 (i) The agency may issue and sell bonds in an amount not to
2-4 exceed $50 million for the purpose provided by Section 3.16A of
2-5 this article. The bonds may be issued, redeemed, or refunded in
2-6 the manner provided by this article for other bonds. The principal
2-7 of and interest on bonds issued under this subsection shall be paid
2-8 from money deposited in the reserve fund as provided by Section
2-9 151.801, Tax Code. The agency shall keep records of bonds issued
2-10 under this subsection separate from records of other bonds the
2-11 agency issues under this section.
2-12 SECTION 3. Section 151.801, Tax Code, is amended by amending
2-13 Subsection (a) and by adding Subsection (e) to read as follows:
2-14 (a) Except for the amounts <amount> allocated under
2-15 Subsections <Subsection> (b) and (e) of this section, all
2-16 proceeds from the collection of the taxes imposed by this chapter
2-17 shall be deposited to the credit of the general revenue fund.
2-18 (e) Eight-tenths of one percent of the proceeds from the
2-19 collection of the taxes imposed by this chapter shall be deposited
2-20 to the credit of the Texas Department of Housing and Community
2-21 Affairs--Housing Finance Division Reserve Fund as created in
2-22 Section 1.02(24), Article 4413(501), Revised Statutes.
2-23 SECTION 4. This Act takes effect September 1, 1993.
2-24 SECTION 5. The importance of this legislation and the
2-25 crowded condition of the calendars in both houses create an
2-26 emergency and an imperative public necessity that the
2-27 constitutional rule requiring bills to be read on three several
3-1 days in each house be suspended, and this rule is hereby suspended.
