                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the offense of making a false report to a peace
    1-3  officer.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 37.08, Penal Code, is amended to read as
    1-6  follows:
    1-7        Sec. 37.08.  False Report to Peace Officer.  (a)  A person
    1-8  commits an offense if he:
    1-9              (1)  reports to a peace officer an offense or incident
   1-10  within the officer's concern, knowing that the offense or incident
   1-11  did not occur; <or>
   1-12              (2)  makes a report to a peace officer relating to an
   1-13  offense or incident within the officer's concern knowing that he
   1-14  has no information relating to the offense or incident; or
   1-15              (3)  makes a report to a peace officer relating to an
   1-16  offense or incident within the officer's concern and in the report
   1-17  intentionally identifies or describes incorrectly a suspect.
   1-18        (b)  An offense under Subsection (a)(1) or (2) of this
   1-19  section is a Class B misdemeanor.  An offense under Subsection
   1-20  (a)(3) of this section is a felony of the third degree.
   1-21        (c)  If conduct constituting an offense under this section
   1-22  also constitutes an offense under another section of this code, the
   1-23  actor may be prosecuted under either section.
   1-24        SECTION 2.  This Act takes effect September 1, 1993.
    2-1        SECTION 3.  The importance of this legislation and the
    2-2  crowded condition of the calendars in both houses create an
    2-3  emergency and an imperative public necessity that the
    2-4  constitutional rule requiring bills to be read on three several
    2-5  days in each house be suspended, and this rule is hereby suspended.
