                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the employment of children.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 8, Chapter 531, Acts of the 67th
    1-5  Legislature, Regular Session, 1981 (Article 5181.1, Vernon's Texas
    1-6  Civil Statutes), is amended by adding Subsection (c) to read as
    1-7  follows:
    1-8        (c)  In addition to any occupation determined to be hazardous
    1-9  under Subsection (a) of this section, the employment of a child
   1-10  younger than 14 years of age who is unaccompanied by a parent,
   1-11  conservator, guardian, or other person who has possession of the
   1-12  child under a court order to sell items or services for or solicit
   1-13  donations for any individual or entity other than a nonprofit
   1-14  organization between the hours of 8 p.m. and 5 a.m. is a hazardous
   1-15  occupation for purposes of this Act.
   1-16        SECTION 2.  Section 12, Chapter 531, Acts of the 67th
   1-17  Legislature, Regular Session, 1981 (Article 5181.1, Vernon's Texas
   1-18  Civil Statutes), is amended to read as follows:
   1-19        Sec. 12.  Penalty.  An offense under this Act is a Class A
   1-20  <C> misdemeanor.
   1-21        SECTION 3.  (a)  The change in law made by Section 2 of this
   1-22  Act applies only to the punishment for an offense committed on or
   1-23  after the effective date of this Act.  For purposes of this
    2-1  section, an offense is committed before the effective date of this
    2-2  Act if any element of the offense occurs before the effective date.
    2-3        (b)  An offense committed before the effective date of this
    2-4  Act is covered by the law in effect when the offense was committed,
    2-5  and the former law is continued in effect for that purpose.
    2-6        SECTION 4.  This Act takes effect September 1, 1993.
    2-7        SECTION 5.  The importance of this legislation and the
    2-8  crowded condition of the calendars in both houses create an
    2-9  emergency and an imperative public necessity that the
   2-10  constitutional rule requiring bills to be read on three several
   2-11  days in each house be suspended, and this rule is hereby suspended.
