A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to driver's licenses and personal identification cards
1-3 issued to certain persons.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 2(c), Chapter 173, Acts of the 47th
1-6 Legislature, Regular Session, 1941 (Article 6687b, Vernon's Texas
1-7 Civil Statutes), is amended to read as follows:
1-8 (c) A person may not receive a driver's license until the
1-9 person <he> surrenders to the Department all valid driver's
1-10 licenses in the person's <his> possession issued to the person
1-11 <him> by this or any other state. The Department shall return a
1-12 <A> surrendered license issued by another state <shall be returned>
1-13 to the state or notify the other state that the license has been
1-14 surrendered to the Department, and inform the other state
1-15 <accompanied by a statement> that the person is licensed in this
1-16 State.
1-17 SECTION 2. Section 11(a), Chapter 173, Acts of the 47th
1-18 Legislature, Regular Session, 1941 (Article 6687b, Vernon's Texas
1-19 Civil Statutes), is amended to read as follows:
1-20 (a) The Department shall, upon payment of the required fee,
1-21 issue to every qualifying applicant a driver's license as applied
1-22 for. The license shall bear a distinguishing number assigned to
1-23 the licensee by the Department, a color photograph of the licensee,
1-24 the full name, date of birth, residence address, and a brief
2-1 description of the licensee, and either a facsimile of the
2-2 signature of the licensee or a space upon which the licensee shall
2-3 write his usual signature with pen and ink immediately upon receipt
2-4 of the license. No license shall be valid until it has been so
2-5 signed by the licensee. The Department shall indicate <print the
2-6 word and number> "UNDER 21" on <across> the face of each original,
2-7 renewed, or duplicate license issued to a licensee younger than 21
2-8 years of age, or shall designate and clearly mark the license as a
2-9 provisional license as provided in Section 11A of this Act.
2-10 <The words and numbers must be in red ink and must be at
2-11 least one-fourth of an inch in height.>
2-12 SECTION 3. Section 14A(a), Chapter 173, Acts of the 47th
2-13 Legislature, Regular Session, 1941 (Article 6687b, Vernon's Texas
2-14 Civil Statutes), is amended to read as follows:
2-15 (a) The Department shall issue personal identification
2-16 cards, similar in form but distinguishable in color from drivers'
2-17 licenses. The Department shall indicate <print the word and
2-18 number> "UNDER 21" on <across> the face of each personal
2-19 identification certificate issued to a person younger than 21 years
2-20 of age. Certificates issued under authority of this section shall
2-21 expire on a date specified by the Department. <The words and
2-22 numbers must be in red ink and must be at least one-fourth of an
2-23 inch in height.>
2-24 SECTION 4. This Act takes effect September 1, 1993. The
2-25 change in law made by Section 1 of this Act applies only to a
2-26 person who applies for a driver's license on or after that date.
2-27 The changes in law made by Sections 2 and 3 of this Act apply only
3-1 to a person who is issued a driver's license or a personal
3-2 identification card on or after that date.
3-3 SECTION 5. The importance of this legislation and the
3-4 crowded condition of the calendars in both houses create an
3-5 emergency and an imperative public necessity that the
3-6 constitutional rule requiring bills to be read on three several
3-7 days in each house be suspended, and this rule is hereby suspended.
