A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the treatment for tax purposes of property held and
1-3 used for public purposes pursuant to an interlocal contract between
1-4 political subdivisions.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Section 791.013, Government Code, is amended by
1-7 adding subsection (c) to read as follows:
1-8 Sec. 791.013. CONTRACT SUPERVISION AND ADMINISTRATION
1-9 (a) The parties to an interlocal contract may create an
1-10 administrative agency or designate an existing local government to
1-11 supervise the performance of the contract.
1-12 (b) The agency or designated local government may employ
1-13 personnel, perform administrative activities, and provide
1-14 administrative services necessary to perform the interlocal
1-15 contract.
1-16 (c) All property that is held and used for public purposes
1-17 by the administrative agency or designated local government shall
1-18 be exempt from or subject to taxation in the same manner as if the
1-19 property was held and used by the participating political
1-20 subdivisions.
1-21 SECTION 2. The importance of this legislation and the
1-22 crowded condition of the calendars in both houses create an
1-23 emergency and an imperative public necessity that the
2-1 constitutional rule requiring bills to be read on three several
2-2 days in each house be suspended, and this rule is hereby suspended.
