A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the use of in-house counsel to provide legal services
1-3 for the Texas School for the Deaf and the Texas School for the
1-4 Blind and Visually Impaired.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Section 402.0211(e), Government Code, is amended
1-7 to read as follows:
1-8 (e) This section does not apply to:
1-9 (1) the governor's office;
1-10 (2) an institution of higher education, as defined by
1-11 Section 61.003, Education Code;
1-12 (3) an agency expressly authorized by the General
1-13 Appropriations Act or other statute to hire or select legal
1-14 counsel;
1-15 (4) an agency governed by one or more elected
1-16 officials;
1-17 (5) an agency with a director appointed by the
1-18 governor;
1-19 (6) the Central Education Agency;
1-20 (7) the Department of Public Safety;
1-21 (8) the Employees Retirement System of Texas or the
1-22 Teacher Retirement System of Texas;
1-23 (9) the Parks and Wildlife Department;
1-24 (10) the State Board of Insurance;
2-1 (11) the Texas <State Highway and Public>
2-2 Transportation Commission or the Texas <State> Department of
2-3 <Highways and Public> Transportation;
2-4 (12) the Texas Department of Criminal Justice;
2-5 (13) the Texas Employment Commission;
2-6 (14) the Texas Higher Education Coordinating Board;
2-7 (15) the Texas Natural Resource Conservation
2-8 Commission;
2-9 (16) the Texas Workers' Compensation Commission; <or>
2-10 (17) the Texas Youth Commission;
2-11 (18) the Texas School for the Deaf; or
2-12 (19) the Texas School for the Blind and Visually
2-13 Impaired.
2-14 SECTION 2. This Act takes effect September 1, 1993.
2-15 SECTION 3. The importance of this legislation and the
2-16 crowded condition of the calendars in both houses create an
2-17 emergency and an imperative public necessity that the
2-18 constitutional rule requiring bills to be read on three several
2-19 days in each house be suspended, and this rule is hereby suspended.
