                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to reimbursement of children committed to the Texas Youth
    1-3  Commission for lost or damaged personal property.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 61.0431(a), Human Resources Code, is
    1-6  amended to read as follows:
    1-7        (a)  Proceeds from the operation of canteens and vending
    1-8  machines at facilities under the jurisdiction of the commission
    1-9  shall be deposited to the credit of a special account in the
   1-10  General Revenue Fund called the canteen revolving fund.  The
   1-11  proceeds shall be used to pay the actual expenses of maintaining
   1-12  and operating the canteens and vending machines.  Proceeds in
   1-13  excess of the amount required for those expenses, donations for
   1-14  student activities and proceeds from children's fundraising
   1-15  projects shall be deposited to the credit of a special account in
   1-16  the General Revenue Fund called the student benefit fund and may be
   1-17  used only to:
   1-18              (1)  provide education, recreation, and entertainment
   1-19  to children committed to the commission; or
   1-20              (2)  reimburse children committed to the commission for
   1-21  personal property lost or damaged as a result of negligence by the
   1-22  staff of the commission.
   1-23        SECTION 2.  This Act applies to the reimbursement of personal
   1-24  property without regard to whether the property was lost or damaged
    2-1  before, on, or after the effective date of this Act.
    2-2        SECTION 3.  The importance of this legislation and the
    2-3  crowded condition of the calendars in both houses create an
    2-4  emergency and an imperative public necessity that the
    2-5  constitutional rule requiring bills to be read on three several
    2-6  days in each house be suspended, and this rule is hereby suspended,
    2-7  and that this Act take effect and be in force from and after its
    2-8  passage, and it is so enacted.
