1-17 A BILL TO BE ENTITLED
1-18 AN ACT
1-19 relating to reimbursement of children committed to the Texas Youth
1-20 Commission for lost or damaged personal property.
1-21 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-22 SECTION 1. Section 61.0431(a), Human Resources Code, is
1-23 amended to read as follows:
1-24 (a) Proceeds from the operation of canteens and vending
1-25 machines at facilities under the jurisdiction of the commission
1-26 shall be deposited to the credit of a special account in the
1-27 General Revenue Fund called the canteen revolving fund. The
1-28 proceeds shall be used to pay the actual expenses of maintaining
1-29 and operating the canteens and vending machines. Proceeds in
1-30 excess of the amount required for those expenses, donations for
1-31 student activities and proceeds from children's fundraising
1-32 projects shall be deposited to the credit of a special account in
1-33 the General Revenue Fund called the student benefit fund and may be
1-34 used only to:
1-35 (1) provide education, recreation, and entertainment
1-36 to children committed to the commission; or
1-37 (2) reimburse children committed to the commission for
1-38 personal property lost or damaged as a result of negligence by the
1-39 staff of the commission.
1-40 SECTION 2. This Act applies to the reimbursement of personal
1-41 property without regard to whether the property was lost or damaged
1-42 before, on, or after the effective date of this Act.
1-43 SECTION 3. The importance of this legislation and the
1-44 crowded condition of the calendars in both houses create an
1-45 emergency and an imperative public necessity that the
1-46 constitutional rule requiring bills to be read on three several
1-47 days in each house be suspended, and this rule is hereby suspended,
1-48 and that this Act take effect and be in force from and after its
1-49 passage, and it is so enacted.
