                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the consent of a person 17 years of age to donate blood
    1-3  or blood components.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Chapter 162, Health and Safety Code, is amended
    1-6  by adding Section 162.015 to read as follows:
    1-7        Sec. 162.015.  DONATION OF BLOOD BY PERSONS YOUNGER THAN 18
    1-8  YEARS OF AGE.  A person who is 17 years of age may consent to the
    1-9  donation of the person's blood or blood components.  A person
   1-10  younger than 18 years of age may not receive any compensation by a
   1-11  blood bank for a donation of the person's blood or blood
   1-12  components.
   1-13        SECTION 2.  The heading to Chapter 162, Health and Safety
   1-14  Code, is amended to read as follows:
   1-15            CHAPTER 162.  BLOOD BANKS AND DONATION OF BLOOD
   1-16        SECTION 3.  Section 35.03(a), Family Code, is amended to read
   1-17  as follows:
   1-18        (a)  A minor may consent to the furnishing of hospital,
   1-19  medical, surgical, and dental care by a licensed physician or
   1-20  dentist if the minor:
   1-21              (1)  is on active duty with the armed services of the
   1-22  United States of America;
   1-23              (2)  is 16 years of age or older and resides separate
    2-1  and apart from his parents, managing conservator, or guardian,
    2-2  whether with or without the consent of the parents, managing
    2-3  conservator, or guardian and regardless of the duration of such
    2-4  residence, and is managing his own financial affairs, regardless of
    2-5  the source of the income;
    2-6              (3)  consents to the diagnosis and treatment of any
    2-7  infectious, contagious or communicable disease which is required by
    2-8  law or regulation adopted pursuant to law to be reported by the
    2-9  licensed physician or dentist to a local health officer or the
   2-10  Texas Department of Health and including all sexually transmitted
   2-11  diseases;
   2-12              (4)  is unmarried and pregnant, and consents to
   2-13  hospital, medical, or surgical treatment, other than abortion,
   2-14  related to her pregnancy; or
   2-15              (5)  <is 18 years of age or older and consents to the
   2-16  donation of his blood and the penetration of tissue necessary to
   2-17  accomplish the donation; or>
   2-18              <(6)>  consents to examination and treatment for
   2-19  chemical addiction, chemical dependency, or any other condition
   2-20  directly related to chemical use.
   2-21        SECTION 4.  This Act takes effect September 1, 1993.
   2-22        SECTION 5.  The importance of this legislation and the
   2-23  crowded condition of the calendars in both houses create an
   2-24  emergency and an imperative public necessity that the
   2-25  constitutional rule requiring bills to be read on three several
    3-1  days in each house be suspended, and this rule is hereby suspended.
