                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to separate property of a spouse.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section  3.63,   Family Code, is amended by
    1-5  adding a new Subsection (c), to read as follows:
    1-6        (c)  In a decree of divorce or annulment the court shall
    1-7  treat the following real and personal property, wherever situated,
    1-8  as the separate property of a spouse:
    1-9              (1)  property that was acquired by a spouse while
   1-10  domiciled elsewhere that would have been separate property if the
   1-11  spouse who acquired the property had been domiciled in this state
   1-12  at the time of the acquisition; or
   1-13              (2)  property that was acquired by a spouse in exchange
   1-14  for real or personal property and that would have been separate
   1-15  property  if the spouse who acquired the property so exchanged had
   1-16  been domiciled in this state at the time of its acquisition.
   1-17        SECTION 2.  This act takes effect September 1, 1993.
   1-18        SECTION 3.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended.
