                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the coordination of leave policies and worker's
    1-3  compensation for school employees.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Chapter 13, Education Code, Subchapter Z, Section
    1-6  13.904(f) is amended to read as follows:
    1-7        (f)  In addition to all other days of leave provided by this
    1-8  section or by the school district, an employee of a school district
    1-9  who is physically assaulted during the performance of his regular
   1-10  duties is entitled to the number of days of leave necessary to
   1-11  recuperate from all physical injuries sustained as a result of the
   1-12  assault.  Days of leave taken under this subsection may not be
   1-13  deducted from accrued sick leave.  The period provided in this
   1-14  subsection shall not extend more than two years beyond the date of
   1-15  the assault.  Notwithstanding any other provision of law, leave
   1-16  policy benefits due to an employee will be coordinated with
   1-17  benefits due from worker's compensation in order that the
   1-18  employee's total compensation will equal 100% of the employee's
   1-19  daily rate of pay.
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended.
