A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to East Texas State University at Texarkana.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Subchapter A, Chapter 100, Education Code, is
1-5 amended by adding Section 100.02 to read as follows:
1-6 Sec. 100.02. EAST TEXAS STATE UNIVERSITY AT TEXARKANA. (a)
1-7 East Texas State University at Texarkana is a coeducational
1-8 upper-level educational institution located in the city of
1-9 Texarkana. The university is under the management and control of a
1-10 board of regents as provided by Section 100.11 of this code.
1-11 (b) The board may adopt rules for the operation, control,
1-12 and management of East Texas State University at Texarkana.
1-13 SECTION 2. Section 100.11, Education Code, is amended to
1-14 read as follows:
1-15 Sec. 100.11. Board of Regents. (a) The organization,
1-16 control, and management of East Texas State University and East
1-17 Texas State University at Texarkana <the university> is vested in a
1-18 board of nine regents appointed by the governor with the advice and
1-19 consent of the senate. East Texas State University <The Texarkana
1-20 campus may not offer freshman or sophomore programs, and the
1-21 metroplex commuter program> may offer only those programs approved
1-22 by the Texas Higher Education Coordinating Board<, Texas College
1-23 and University System> and which are nonduplicative of programs
1-24 offered in the Dallas educational area. The board of regents may
2-1 establish different rules for the operation of the facilities and
2-2 programs in each location.
2-3 (b) The members hold office for staggered terms of six
2-4 years, with the terms of three regents expiring on February 15 of
2-5 each odd-numbered year. The board shall elect a chairman and any
2-6 other officers from its members to serve at the will of the board.
2-7 (c) The board has the powers and duties incident to its
2-8 position and to the same extent as is conferred on the Board of
2-9 Regents of Texas Woman's University.
2-10 SECTION 3. Sections 100.32, 100.33, 100.34, and 100.36,
2-11 Education Code, are amended to read as follows:
2-12 Sec. 100.32. Degrees. The board may award bachelor's,
2-13 master's, and doctor's degrees and their equivalents at East Texas
2-14 State University and at East Texas State University at Texarkana,
2-15 but no department, school, or degree program shall be instituted
2-16 except with the prior approval of the Texas Higher Education
2-17 Coordinating Board<, Texas College and University System>.
2-18 Sec. 100.33. Donations, Gifts, Grants, Endowments. The
2-19 board may accept donations, gifts, grants, and endowments for East
2-20 Texas State University or East Texas State University at Texarkana
2-21 <the university> to be held in trust and administered by the board
2-22 for the purposes and under the directions, limitations, and
2-23 provisions declared in writing in the donation, gift, grant, or
2-24 endowment, not inconsistent with the laws of the state or with the
2-25 objectives and proper management of the universities <university>.
2-26 Sec. 100.34. Lease of University Property. The board may
2-27 lease any part of the <university's> property of East Texas State
3-1 University or East Texas State University at Texarkana to any
3-2 person, partnership, special partnership, business association, or
3-3 institution, including governmental entities, for the purpose of
3-4 permitting the universities <university> to develop their <its>
3-5 resources to the greatest extent feasible while realizing a maximum
3-6 economic benefit.
3-7 Sec. 100.36. Management of Lands. The board has the sole
3-8 and exclusive management and control of lands set aside and
3-9 appropriated to or acquired by East Texas State University or East
3-10 Texas State University at Texarkana <the university>. The board
3-11 may sell, lease, and otherwise manage, control, and use the lands
3-12 in any manner and at prices and under terms and conditions the
3-13 board deems best for the interest of the universities <university>.
3-14 Land shall not be sold at a price less per acre than that at which
3-15 the same class of other public land may be sold under the statutes.
3-16 No grazing lease shall be made for a period of more than 10 years.
3-17 SECTION 4. The importance of this legislation and the
3-18 crowded condition of the calendars in both houses create an
3-19 emergency and an imperative public necessity that the
3-20 constitutional rule requiring bills to be read on three several
3-21 days in each house be suspended, and this rule is hereby suspended,
3-22 and that this Act take effect and be in force from and after its
3-23 passage, and it is so enacted.
