1-20 AN ACT
1-21 relating to East Texas State University at Texarkana.
1-22 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-23 SECTION 1. Subchapter A, Chapter 100, Education Code, is
1-24 amended by adding Section 100.02 to read as follows:
1-25 Sec. 100.02. EAST TEXAS STATE UNIVERSITY AT TEXARKANA.
1-26 (a) East Texas State University at Texarkana is a coeducational
1-27 upper-level educational institution located in the city of
1-28 Texarkana.
1-29 (b) The university is under the management and control of a
1-30 board of regents as provided by Section 100.11 of this code.
1-31 (c) The board may adopt rules for the operation, control,
1-32 and management of East Texas State University at Texarkana.
1-33 (d) East Texas State University at Texarkana may not offer
1-34 freshman or sophomore programs.
1-35 SECTION 2. Section 100.11, Education Code, is amended to
1-36 read as follows:
1-37 Sec. 100.11. Board of Regents. (a) The organization,
1-38 control, and management of East Texas State University and East
1-39 Texas State University at Texarkana <the university> is vested in a
1-40 board of nine regents appointed by the governor with the advice and
1-41 consent of the senate. The <Texarkana campus may not offer
1-42 freshman or sophomore programs, and the> metroplex commuter program
1-43 may offer only those programs approved by the Texas Higher
1-44 Education Coordinating Board<, Texas College and University System>
1-45 and which are nonduplicative of programs offered in the Dallas
1-46 educational area. The board of regents may establish different
1-47 rules for the operation of the facilities and programs in each
1-48 location.
1-49 (b) The members hold office for staggered terms of six
1-50 years, with the terms of three regents expiring on February 15 of
1-51 each odd-numbered year. The board shall elect a chairman and any
1-52 other officers from its members to serve at the will of the board.
1-53 (c) The board has the powers and duties incident to its
1-54 position and to the same extent as is conferred on the Board of
1-55 Regents of Texas Woman's University.
1-56 SECTION 3. Sections 100.32, 100.33, 100.34, and 100.36,
1-57 Education Code, are amended to read as follows:
1-58 Sec. 100.32. Degrees. The board may award bachelor's,
1-59 master's, and doctor's degrees and their equivalents, but no
1-60 department, school, or degree program shall be instituted except
1-61 with the prior approval of the Texas Higher Education Coordinating
1-62 Board<, Texas College and University System>.
1-63 Sec. 100.33. Donations, Gifts, Grants, Endowments. The
1-64 board may accept donations, gifts, grants, and endowments for East
1-65 Texas State University or East Texas State University at Texarkana
1-66 <the university> to be held in trust and administered by the board
1-67 for the purposes and under the directions, limitations, and
1-68 provisions declared in writing in the donation, gift, grant, or
2-1 endowment, not inconsistent with the laws of the state or with the
2-2 objectives and proper management of the universities <university>.
2-3 Sec. 100.34. Lease of University Property. The board may
2-4 lease any part of the <university's> property of East Texas State
2-5 University or East Texas State University at Texarkana to any
2-6 person, partnership, special partnership, business association, or
2-7 institution, including governmental entities, for the purpose of
2-8 permitting the universities <university> to develop their <its>
2-9 resources to the greatest extent feasible while realizing a maximum
2-10 economic benefit.
2-11 Sec. 100.36. Management of Lands. The board has the sole
2-12 and exclusive management and control of lands set aside and
2-13 appropriated to or acquired by East Texas State University or East
2-14 Texas State University at Texarkana <the university>. The board
2-15 may sell, lease, and otherwise manage, control, and use the lands
2-16 in any manner and at prices and under terms and conditions the
2-17 board deems best for the interest of the universities <university>.
2-18 Land shall not be sold at a price less per acre than that at which
2-19 the same class of other public land may be sold under the statutes.
2-20 No grazing lease shall be made for a period of more than 10 years.
2-21 SECTION 4. The importance of this legislation and the
2-22 crowded condition of the calendars in both houses create an
2-23 emergency and an imperative public necessity that the
2-24 constitutional rule requiring bills to be read on three several
2-25 days in each house be suspended, and this rule is hereby suspended,
2-26 and that this Act take effect and be in force from and after its
2-27 passage, and it is so enacted.
