                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to inspection, labeling, and sale of agricultural and
    1-3  vegetable seed.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 61.016(c), Agriculture Code, is amended
    1-6  to read as follows:
    1-7        (c)  This chapter does not prevent one farmer from selling to
    1-8  another farmer seed grown on his or her own farm without having the
    1-9  seed tested or labeled as required by this chapter if the seed:
   1-10              <(1)  is not advertised in the public communications
   1-11  media outside the vendor's home county;>
   1-12              <(2)> (1)  is not sold or offered or exposed for sale
   1-13  by an individual or organization for the farmer; and
   1-14              <(3)> (2)  is not shipped by a common carrier.
   1-15        SECTION 2.  This Act takes effect September 1, 1993, and
   1-16  applies only to agricultural or vegetable seed sold on or after
   1-17  that date.
   1-18        SECTION 3.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended.
