1-19 BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to the purchase and sale of certain fish taken from fresh
1-22 water in certain counties.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Section 66.111(b), Parks and Wildlife Code, is
1-25 amended to read as follows:
1-26 (b) Subsection (a) of this section does not apply to:
1-27 (1) a fish, other than a bass of the genus
1-28 Micropterus, reared in private water under a fish farmer's license;
1-29 (2) a fish possessed legally outside this state and
1-30 transported into this state;
1-31 (3) bass of the genus Micropterus reared in private
1-32 water under a fish farmer's license and marketed for the purpose of
1-33 stocking the water of this state;
1-34 (4) nongame fish regulated under Chapter 67 of this
1-35 code;
1-36 (5) channel catfish of more than 14 inches in length
1-37 or blue catfish of more than 14 inches in length taken from the
1-38 public fresh water of Angelina, Bastrop, Bowie, Camp, Cass,
1-39 Chambers, Colorado, Fayette, Franklin, Freestone, Gregg, Hardin,
1-40 Harris, Harrison, Jasper, Jefferson, Lamar, Leon, Liberty, Madison,
1-41 Marion, Matagorda, Montgomery, Morris, Nacogdoches, Navarro,
1-42 Newton, Orange, Panola, Polk, Red River, Sabine, San Augustine, San
1-43 Jacinto, Shelby, Titus, Trinity, Tyler, Upshur, <or> Walker, or
1-44 Wharton County, or the public fresh water of the Neches or Trinity
1-45 River in Houston County; or
1-46 (6) minnows to be used as bait fish taken from the
1-47 public fresh waters in Clay, Cottle, Hardeman, Motley, Wichita, or
1-48 Wilbarger County.
1-49 SECTION 2. This Act takes effect September 1, 1993.
1-50 SECTION 3. The importance of this legislation and the
1-51 crowded condition of the calendars in both houses create an
1-52 emergency and an imperative public necessity that the
1-53 constitutional rule requiring bills to be read on three several
1-54 days in each house be suspended, and this rule is hereby suspended.
