A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to eligibility for service retirement of members of the
1-3 elected class of the Employees Retirement System of Texas.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 814.102, Government Code, is amended to
1-6 read as follows:
1-7 Sec. 814.102. ELIGIBILITY OF ELECTED MEMBERS FOR SERVICE
1-8 RETIREMENT. (a) Except as provided by Subsection (b) or by rule
1-9 adopted under Section 813.304(d) or Section 803.202(2), a member
1-10 who has service credit in the elected class of membership<,> is
1-11 eligible to retire and receive a service retirement annuity if the
1-12 member:
1-13 (1) is at least 60 years old and has 8 years of
1-14 service credit in that class; or
1-15 (2) is at least 50 years old and has 12 years of
1-16 service credit in that class.
1-17 (b) A member who has service credit in the elected class of
1-18 membership and whose membership in that class first began after
1-19 December 31, 1992, is eligible to retire and receive a service
1-20 retirement annuity if the member:
1-21 (1) is at least 60 years old and has 10 years of
1-22 service credit in the retirement system; or
1-23 (2) is at least 55 years old and has 12 years of
1-24 service credit in the retirement system.
2-1 SECTION 2. This Act takes effect September 1, 1993.
2-2 SECTION 3. The importance of this legislation and the
2-3 crowded condition of the calendars in both houses create an
2-4 emergency and an imperative public necessity that the
2-5 constitutional rule requiring bills to be read on three several
2-6 days in each house be suspended, and this rule is hereby suspended.
