No. 1719 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 making appropriations for and directing payment of certain 1-3 miscellaneous claims and judgments out of funds designated herein; 1-4 requiring approval of the claims in the manner specified in this 1-5 Act before payment is made. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. The following sums of money are hereby 1-8 appropriated out of the General Revenue Fund No. 001 for payment of 1-9 itemized claims and judgments plus interest, if any, against the 1-10 State of Texas as follows: 1-11 To pay Enrique H. Cantu for warrant voided by statute of 1-12 limitations. $28.70 1-13 To pay Steve D. Thompson Trucking, Inc., for warrant voided 1-14 by statute of limitations. $3,515.50 1-15 To pay Steve D. Thompson Trucking, Inc., for warrant voided 1-16 by statue of limitations. $8,519.60 1-17 To pay Philip Ray Pool for warrant voided by statute of 1-18 limitations. $25.00 1-19 To pay Bob Smith Corporation for outstanding invoice for 1-20 welding supplies. $946.58 1-21 To pay the estate of Milton V. Arnold for warrant voided by 1-22 statute of limitations. $27.60 1-23 To pay GCA Corporation for warrant voided by statute of 2-1 limitations. $3,476.93 2-2 To pay Ebsco Subscription Service for warrant voided by 2-3 statute of limitations. $2,375.61 2-4 To pay Ruth M. Seeger for warrant voided by statute of 2-5 limitations. $52.00 2-6 To pay the City of Shepherd for warrant voided by statute of 2-7 limitations. $3,278.93 2-8 SECTION 2. The following sums of money are hereby 2-9 appropriated out of Fund No. 166 for payment of itemized claims and 2-10 judgments plus interest, if any, against the State of Texas as 2-11 follows: 2-12 To pay Beverly Enterprises DBA Leisure Lodge Texarkana for 2-13 unpaid charges for nursing home care for Medicaid recipients. 2-14 $311.45 2-15 To pay Beverly Enterprises DBA Vista Hills Health Care Center 2-16 for unpaid charges for nursing home care for Medicaid recipients. 2-17 $530.18 2-18 To pay ARA Living Centers DBA San Augustine for unpaid 2-19 charges for nursing home care for Medicaid recipients. $814.46 2-20 To pay Beverly Enterprises DBA Leisure Lodge Sulphur Springs 2-21 for unpaid charges for nursing home care for Medicaid recipients. 2-22 $40.30 2-23 SECTION 3. It is specifically provided that before any claim 2-24 or judgment shall be paid from funds hereby appropriated, the same 2-25 shall be verified and substantiated by the administrator of the 3-1 special fund or account against which the claim is to be charged, 3-2 and have the approval of the Attorney General and the State 3-3 Comptroller. It is further provided that any claim or judgment 3-4 itemized in this bill which has not been verified and substantiated 3-5 by the administrator of the special fund or account and approved by 3-6 the Attorney General and the State Comptroller by August 31, 1994, 3-7 shall not be paid from funds appropriated. It is further provided 3-8 that each claim must contain such information as required by the 3-9 Comptroller, but at a minimum must contain the specific reason for 3-10 the claim. If the claim is for a void warrant, the claim must 3-11 include a specific identification of the goods, services, refund, 3-12 or other item for which the warrant was originally issued. In 3-13 addition, it must include the original payee's or its successor, 3-14 heirs, or assigns certification that the debt is still outstanding. 3-15 If the claim is for unpaid goods or services, it must be 3-16 accompanied by an invoice or other acceptable documentation of the 3-17 unpaid account and any other information that may be required by 3-18 the Comptroller. 3-19 SECTION 4. Subject to the conditions and restrictions in 3-20 this Act and provisions stated in the judgments, the Comptroller is 3-21 hereby authorized and directed to issue a warrant or warrants on 3-22 the State Treasury, as soon as possible following the effective 3-23 date of this Act, in the favor of each of the said persons, firms, 3-24 or corporations named herein, in an amount not to exceed the amount 3-25 set opposite their respective names and shall mail or deliver to 4-1 each of the said persons, firms, or corporations warrant or 4-2 warrants in payment of the said claim or claims. 4-3 SECTION 5. This Act shall take effect September 1, 1993. 4-4 SECTION 6. The importance of this legislation and the 4-5 crowded condition of the calendars in both houses create an 4-6 emergency and an imperative public necessity that the 4-7 constitutional rule requiring bills to be read on three several 4-8 days in each house be suspended, and this rule is hereby suspended.
