                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the appraisal of certain property for ad valorem tax
    1-3  purposes.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter B, Chapter 23, Tax Code, is amended by
    1-6  adding Section 23.14 to read as follows:
    1-7        Sec. 23.14.  APPRAISAL OF PROPERTY SUBJECT TO ENVIRONMENTAL
    1-8  RESPONSE REQUIREMENT.  (a)  In this section, "environmental
    1-9  response requirement" means remedial action required of a property
   1-10  owner to correct, mitigate, or prevent a present or future injury
   1-11  to the public health or safety or to the environment imposed on the
   1-12  owner of real property by the United States, this state, or any
   1-13  political subdivision of this state.
   1-14        (b)  In appraising real property that the chief appraiser
   1-15  knows is subject to an environmental response requirement, the
   1-16  estimated cost to the owner of the property to comply with the
   1-17  environmental response requirement is an appropriate element and
   1-18  shall be taken into consideration by the chief appraiser in
   1-19  determining the market value of the property.
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended.
