1-20 A BILL TO BE ENTITLED
1-21 AN ACT
1-22 relating to the appraisal of certain property for ad valorem tax
1-23 purposes.
1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-25 SECTION 1. Subchapter B, Chapter 23, Tax Code, is amended by
1-26 adding Section 23.14 to read as follows:
1-27 Sec. 23.14. APPRAISAL OF PROPERTY SUBJECT TO ENVIRONMENTAL
1-28 RESPONSE REQUIREMENT. (a) In this section, "environmental
1-29 response requirement" means remedial action by a property owner to
1-30 correct, mitigate, or prevent a present or future air, water, or
1-31 land pollution.
1-32 (b) In appraising real property that the chief appraiser
1-33 knows is subject to an environmental response requirement, the
1-34 present value of the estimated cost to the owner of the property of
1-35 the environmental response requirement is an appropriate element
1-36 that reduces market value and shall be taken into consideration by
1-37 the chief appraiser in determining the market value of the
1-38 property.
1-39 SECTION 2. The importance of this legislation and the
1-40 crowded condition of the calendars in both houses create an
1-41 emergency and an imperative public necessity that the
1-42 constitutional rule requiring bills to be read on three several
1-43 days in each house be suspended, and this rule is hereby suspended.
