                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the release of information kept in vessel and boat
    1-3  records.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter B-1, Chapter 31, Parks and Wildlife
    1-6  Code, is amended by adding Section 31.056 to read as follows:
    1-7        Sec. 31.056.  RELEASE OF INFORMATION.  (a)  The department or
    1-8  a county may not release to any person the name and address of any
    1-9  person contained in the vessel and outboard motor records in
   1-10  response to a telephone inquiry.  The department or a county may
   1-11  release the name and address only if the request is in writing.
   1-12  The written request must contain the requestor's name and address
   1-13  and must state that the use of the information is for a lawful and
   1-14  legitimate purpose.
   1-15        (b)  This section does not apply to the release of
   1-16  information to:
   1-17              (1)  a peace officer, as that term is defined in
   1-18  Article 2.12, Code of Criminal Procedure, if the officer is acting
   1-19  in an official capacity; or
   1-20              (2)  an official of the state, a city, a town, a
   1-21  county, a special district, or another political subdivision of the
   1-22  state if the official is requesting the information for tax
   1-23  purposes.
   1-24        SECTION 2.  This Act takes effect September 1, 1993.
    2-1        SECTION 3.  The importance of this legislation and the
    2-2  crowded condition of the calendars in both houses create an
    2-3  emergency and an imperative public necessity that the
    2-4  constitutional rule requiring bills to be read on three several
    2-5  days in each house be suspended, and this rule is hereby suspended.
