                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the release of information kept in vessel and boat
    1-3  records.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Parks and Wildlife Code, is amended by adding
    1-6  Section 31.056.  RELEASE OF INFORMATION:
    1-7        (a)  The department or a county may not release to any person
    1-8  the name and address of any person contained in the vessel and
    1-9  outboard motor records in response to a telephone inquiry.  The
   1-10  department or a county may release the name and address only if the
   1-11  request is in writing.  The written request must contain the
   1-12  requestor's name and address and must state that the use of the
   1-13  information is for a lawful and legitimate purpose.
   1-14        (b)  This section does not apply to the release of
   1-15  information to:
   1-16              (1)  a peace officer, as that term is defined in
   1-17  Article 2.12, Code of Criminal Procedures, if the officer is acting
   1-18  in an official capacity; or
   1-19              (2)  an official of the state, a city, town, county,
   1-20  special district, or other political subdivision of the state if
   1-21  the official is requesting the information for tax purposes.
   1-22        SECTION 2.  This Act takes effect September 1, 1993.
   1-23        SECTION 3.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended.
