                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to release of information kept in vessel and boat records.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 31.039, Parks and Wildlife Code, is
    1-5  amended to read as follows:
    1-6        Sec. 31.039.  PUBLIC RECORDS.  The department or a county may
    1-7  not release the name or address of a person in <All> ownership
    1-8  records <of the department> made or kept by the department or
    1-9  county under this chapter unless the request for the information is
   1-10  in writing and:
   1-11              (1)  contains:
   1-12                    (A)  the name and address of the person
   1-13  requesting the information; and
   1-14                    (B)  a statement that the information is to be
   1-15  used for a lawful purpose; or
   1-16              (2)  is made by:
   1-17                    (A)  a peace officer, as defined under Article
   1-18  2.12, Code of Criminal Procedure, if the officer is acting in an
   1-19  official capacity; or
   1-20                    (B)  an official of the state or a political
   1-21  subdivision of the state if the information is requested for tax
   1-22  purposes <are public records>.
   1-23        SECTION 2.  This Act takes effect September 1, 1993.
   1-24        SECTION 3.  The importance of this legislation and the
    2-1  crowded condition of the calendars in both houses create an
    2-2  emergency and an imperative public necessity that the
    2-3  constitutional rule requiring bills to be read on three several
    2-4  days in each house be suspended, and this rule is hereby suspended.
