1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to the use of in-house counsel by the Banking Department
1-24 of Texas.
1-25 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-26 SECTION 1. Section 402.0211(e), Government Code, is amended
1-27 to read as follows:
1-28 (e) This section does not apply to:
1-29 (1) the governor's office;
1-30 (2) an institution of higher education, as defined by
1-31 Section 61.003, Education Code;
1-32 (3) an agency expressly authorized by the General
1-33 Appropriations Act or other statute to hire or select legal
1-34 counsel;
1-35 (4) an agency governed by one or more elected
1-36 officials;
1-37 (5) an agency with a director appointed by the
1-38 governor;
1-39 (6) the Central Education Agency;
1-40 (7) the Department of Public Safety;
1-41 (8) the Employees Retirement System of Texas or the
1-42 Teacher Retirement System of Texas;
1-43 (9) the Parks and Wildlife Department;
1-44 (10) the State Board of Insurance;
1-45 (11) the State Highway and Public Transportation
1-46 Commission or the State Department of Highways and Public
1-47 Transportation;
1-48 (12) the Texas Department of Criminal Justice;
1-49 (13) the Texas Employment Commission;
1-50 (14) the Texas Higher Education Coordinating Board;
1-51 (15) the Texas Natural Resource Conservation
1-52 Commission;
1-53 (16) the Texas Workers' Compensation Commission; <or>
1-54 (17) the Texas Youth Commission; or
1-55 (18) the Banking Department of Texas.
1-56 SECTION 2. This Act takes effect September 1, 1993.
1-57 SECTION 3. The importance of this legislation and the
1-58 crowded condition of the calendars in both houses create an
1-59 emergency and an imperative public necessity that the
1-60 constitutional rule requiring bills to be read on three several
1-61 days in each house be suspended, and this rule is hereby suspended.
