                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the allocation of funds to school districts that
    1-3  experience significant unanticipated increases in the enrollment of
    1-4  nonhandicapped students residing in residential facilities.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Section 16.152, Education Code, is amended by
    1-7  adding Subsections (m) and (n) to read as follows:
    1-8        (m)  From the total amount of funds appropriated for
    1-9  allotments under this section, the commissioner of education may
   1-10  withhold an amount not exceeding $1,000,000 each fiscal year and
   1-11  distribute the funds to school districts that incur unanticipated
   1-12  expenditures resulting from a significant increase in the
   1-13  enrollment of nonhandicapped students who reside in residential
   1-14  placement facilities.
   1-15        (n)  After deducting the amount withheld under Subsection (m)
   1-16  of this section from the total amount appropriated for the
   1-17  allotment under Subsection (a) of this section, the commissioner of
   1-18  education shall reduce each district's allotment under Subsection
   1-19  (a) proportionately.
   1-20        SECTION 2.  This Act takes effect September 1, 1993.
   1-21        SECTION 3.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency   and   an   imperative   public   necessity   that   the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
