                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to electronic service of a subpoena in certain counties.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Chapter 24, Code of Criminal Procedure, is
    1-5  amended by adding Article 24.041 to read as follows:
    1-6        Art. 24.041.  ELECTRONIC SERVICE IN CERTAIN COUNTIES.  In a
    1-7  county with a population of more than 1.8 million, a subpoena may
    1-8  be served by electronic transmission with electronic acknowledgment
    1-9  from the witness that the information has been received.
   1-10        SECTION 2.  This Act takes effect September 1, 1993.
   1-11        SECTION 3.  The importance of this legislation and the
   1-12  crowded condition of the calendars in both houses create an
   1-13  emergency and an imperative public necessity that the
   1-14  constitutional rule requiring bills to be read on three several
   1-15  days in each house be suspended, and this rule is hereby suspended.
