                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to a municipality's retention of a person licensed to
    1-3  perform inspections, surveys, or removal of asbestos.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 4C, Texas Asbestos Health Protection Act
    1-6  (Article 4477-3a, Vernon's Texas Civil Statutes), is amended to
    1-7  read as follows:
    1-8        Sec. 4C.  A person licensed under this Act to perform
    1-9  asbestos inspections or surveys, write management plans, or design
   1-10  abatement specifications for an asbestos abatement project may not
   1-11  also be engaged in the removal of asbestos from that building or
   1-12  facility unless retained to do so by a municipality.
   1-13        SECTION 2.  The importance of this legislation and the
   1-14  crowded condition of the calendars in both houses create an
   1-15  emergency and an imperative public necessity that the
   1-16  constitutional rule requiring bills to be read on three several
   1-17  days in each house be suspended, and this rule is hereby suspended.
