                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to county purchase of road construction material.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 262.027, Local Government Code, is
    1-5  amended by amending Subsection (a) and adding Subsection (e) to
    1-6  read as follows:
    1-7        (a)  The officer in charge of opening the bids shall present
    1-8  them to the commissioners court in session.  Except as provided by
    1-9  Subsection (e), the <The> court shall:
   1-10              (1)  award the contract to the responsible bidder who
   1-11  submits the lowest and best bid; or
   1-12              (2)  reject all bids and publish a new notice.
   1-13        (e)  In determining the lowest and best bid for a contract
   1-14  for the purchase of road construction material, the commissioners
   1-15  court may consider the pickup and delivery locations of the bidders
   1-16  and the cost to the county of delivering or hauling the material to
   1-17  be purchased.  The commissioners court may award contracts for the
   1-18  purchase of road construction material to more than one bidder if
   1-19  each of the selected bidders submits the lowest and best bid for a
   1-20  particular location or type of material.
   1-21        SECTION 2.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended,
    2-2  and that this Act take effect and be in force from and after its
    2-3  passage, and it is so enacted.
