1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to the sworn statement, bond, and oath of a director of an
1-22 underground water conservation district.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Section 52.108, Water Code, is amended to read as
1-25 follows:
1-26 Sec. 52.108. SWORN STATEMENT, BOND, AND OATH OF OFFICE.
1-27 (a) As soon as practicable after a director is elected or
1-28 appointed, the <Each> director shall make the sworn statement
1-29 prescribed by the constitution for public office <take the oath of
1-30 office prescribed by the constitution for public officers>.
1-31 (b) As soon as practicable after a director has made the
1-32 sworn statement and before beginning to perform the duties of
1-33 office, the director shall take the oath of office prescribed by
1-34 the constitution for public officers.
1-35 (c) Before beginning to perform the duties of office, a
1-36 director shall execute a bond for $10,000 payable to the district
1-37 and conditioned on the faithful performance of the director's
1-38 duties. All bonds of the directors must be approved by the board
1-39 and shall be paid for by the district.
1-40 (d) The sworn statement, bond, and oath shall be filed with
1-41 the district and retained in its records. A duplicate original of
1-42 the sworn statement and the oath shall be filed with the secretary
1-43 of state within 10 days after their execution and need not be filed
1-44 before the new director begins to perform the duties of office.
1-45 SECTION 2. This Act takes effect September 1, 1993.
1-46 SECTION 3. The importance of this legislation and the
1-47 crowded condition of the calendars in both houses create an
1-48 emergency and an imperative public necessity that the
1-49 constitutional rule requiring bills to be read on three several
1-50 days in each house be suspended, and this rule is hereby suspended.
