   1-21                         A BILL TO BE ENTITLED
   1-22                                AN ACT
   1-23  relating to the renewal of certain business, occupational, and
   1-24  professional licenses.
   1-25        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-26        SECTION 1.  DEFINITIONS.  In this Act:
   1-27              (1)  "License" means any license, certificate,
   1-28  registration, permit, or other form of authorization that must be
   1-29  obtained by an individual to engage in a particular business,
   1-30  occupation, or profession.
   1-31              (2)  "State agency" means any department, board,
   1-32  bureau, commission, committee, division, office, council, or agency
   1-33  of the state.
   1-34        SECTION 2.  RENEWAL OF LICENSE.  (a)  Notwithstanding any
   1-35  other provision of law, a state agency that issues a license shall
   1-36  renew the license of an individual whose license has expired  when
   1-37  the individual has met renewal requirements and paid the required
   1-38  renewal fee.  An individual may not be required to pass an
   1-39  examination to renew the license.
   1-40        (b)  Subsection (a) of this section does not apply to an
   1-41  individual whose license has been:
   1-42              (1)  revoked or suspended by a state agency; or
   1-43              (2)  expired for more than two years.
   1-44        (c)  If an individual seeks to renew a license that has been
   1-45  expired for more than two years, the state agency that issued the
   1-46  license shall review the application of the individual and may
   1-47  renew the license once the individual meets existing requirements
   1-48  for renewal and pays all required fees.
   1-49        SECTION 3.  ADOPTION OF RULES.  A state agency that is
   1-50  subject to this Act shall adopt rules that comply with the
   1-51  requirements of this Act for the renewal of a license issued by the
   1-52  agency not later than November 1, 1993.
   1-53        SECTION 4.  EFFECTIVE DATE.  (a)  This Act takes effect
   1-54  September 1, 1993.
   1-55        (b)  This Act applies only to the renewal of a license by a
   1-56  state agency on or after November 1, 1993.
   1-57        SECTION 5.  EMERGENCY.  The importance of this legislation
   1-58  and the crowded condition of the calendars in both houses create an
   1-59  emergency and an imperative public necessity that the
   1-60  constitutional rule requiring bills to be read on three several
   1-61  days in each house be suspended, and this rule is hereby suspended.
