By Black H.B. No. 1896 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to agreements with other states regarding the issuance of 1-3 permits for the transportation of a vehicle and its load or a 1-4 combination of vehicles and load that exceed legal size or weight 1-5 limitations. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. (a) "Permit" means any permit issued by the 1-8 Texas Department of Transportation, in accordance with law, 1-9 authorizing the transportation of a vehicle and its load or a 1-10 combination of vehicles and load that exceed legal size and weight 1-11 limits. 1-12 "Commission" means the Texas Transportation Commission. 1-13 "Department" means the Texas Department of Transportation. 1-14 (b) The Commission may authorize the executive director to 1-15 enter into an agreement or agreements with duly authorized 1-16 officials of other states to provide the issuance of permits on 1-17 behalf of this State and other states. 1-18 (c) A permit issued under this Act by another state on 1-19 behalf of this State is valid as if issued by this State, and the 1-20 permittee is subject to all applicable laws of this State and rules 1-21 of the commission. 1-22 (d) The department may adopt such rules as may be necessary 1-23 to carry out the provisions of this Act and of any agreement 2-1 entered into under this Act. 2-2 (e) All fees collected for other states under the provisions 2-3 of an agreement entered into under this Act shall be distributed to 2-4 the appropriate state at the direction of the Department to carry 2-5 out the provisions of such agreement. There is hereby created a 2-6 special fund account in the State Treasury, to be known as the 2-7 Permit Distributive Fund, and all such fees collected shall be 2-8 deposited and disbursed through such account. 2-9 SECTION 2. The importance of this legislation and the 2-10 crowded condition of the calendars in both houses create an 2-11 emergency and an imperative public necessity that the 2-12 constitutional rule requiring bills to be read on three several 2-13 days in each house be suspended, and this rule is hereby suspended.
