A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the requirements for licensing of public employees who
1-3 perform pest control services.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Article 135b-6, the Structural Pest Control Act,
1-6 is amended by amending Sec. 4B(b) to read as follows:
1-7 (b) An individual must be licensed as a certified
1-8 noncommercial applicator if the individual is not licensed as a
1-9 certified commercial applicator and the individual:
1-10 (1) is an employee of the state or a city or county
1-11 not excepted from the licensing provisions of this Act under
1-12 Section 5(b) or Section 11 of this Act who <and> engages in the
1-13 business of structural pest control; or
1-14 (2) is an employee of a person who owns, operates, or
1-15 maintains a building, the individual engages in the business of
1-16 structural pest control in the building, and the building is an
1-17 apartment building; day-care center; hospital; nursing home; hotel;
1-18 motel; lodge; warehouse; food-processing establishment, other than
1-19 a restaurant, retail food, or food service establishment; school or
1-20 educational institution.
1-21 SECTION 2. EMERGENCY. The importance of this legislation
1-22 and the crowded condition of the calendars in both houses create an
1-23 emergency and an imperative public necessity that the
2-1 constitutional rule requiring bills to be read on three several
2-2 days in each house be suspended, and this rule is hereby suspended.
