1-20 AN ACT
1-21 relating to the creation of the Petroleum Storage Tank Advisory
1-22 Committee.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Section 1(2), Chapter 244, Acts of the 71st
1-25 Legislature, Regular Session, 1989 (Article 8900, Vernon's Texas
1-26 Civil Statutes), is amended to read as follows:
1-27 (2) "Committee" means the Petroleum <Underground>
1-28 Storage Tank Advisory Committee.
1-29 SECTION 2. Section 10, Chapter 244, Acts of the 71st
1-30 Legislature, Regular Session, 1989 (Article 8900, Vernon's Texas
1-31 Civil Statutes), is amended to read as follows:
1-32 Sec. 10. ADVISORY COMMITTEE. (a) The Petroleum
1-33 <Underground> Storage Tank Advisory Committee is established.
1-34 (b) The committee is composed of nine members appointed by
1-35 the governor with the advice and consent of the senate. Committee
1-36 members serve for staggered six-year terms, with the terms of three
1-37 members expiring February 1 of each odd-numbered year. A member is
1-38 not eligible for appointment to successive terms.
1-39 (c) The governor shall appoint all members of the committee,
1-40 of whom: <one member from each of the following geographical areas
1-41 of this state:>
1-42 <(1) the Gulf Coast area;>
1-43 <(2) the Trans-Pecos area;>
1-44 <(3) the central Texas area;>
1-45 <(4) the northeast Texas area; and>
1-46 <(5) the Panhandle-South Plains area.>
1-47 (1) no more than three members may be appointed from a
1-48 single metropolitan area;
1-49 (2) three <(d) Three> members <of the committee> must
1-50 be persons with experience in the operation <installation> of
1-51 underground storage tanks; <and who must obtain an installer's
1-52 license from the commission within two years of the effective date
1-53 of this Act.>
1-54 (3) one member <(e) Two members> must be a
1-55 professional engineer <engineers> registered to practice in this
1-56 state;<.>
1-57 (4) one <(f) One> member must be a person who is not
1-58 eligible for a license under this Act but who has demonstrated
1-59 experience in environmental protection, fire protection, or the
1-60 operation and maintenance of underground storage tanks;<.>
1-61 (5) three <(g) Three> members must be persons who own
1-62 construction firms engaged in installation of underground petroleum
1-63 storage tanks <engineering construction> in the State of Texas; and
1-64 (6) one member must be a representative of the
1-65 financial industry with experience in underground storage tank
1-66 corrective action.
1-67 (d) <(h)> The governor annually shall designate one member
1-68 to serve as chairman. The committee, at a minimum, shall meet
2-1 quarterly, at the call of the chairman, or at the call of the
2-2 chairman of the commission.
2-3 (e) <(i)> The committee shall provide technical expertise to
2-4 the commission regarding petroleum <underground> storage tanks and
2-5 shall advise the commission in the adoption of rules pertaining to
2-6 the commission's petroleum storage tank program (31 TAC Chapter
2-7 334) and for the licensing and regulation of installers and
2-8 corrective action specialists.
2-9 <(j) A committee member is entitled to receive the
2-10 compensatory per diem authorized by the General Appropriations Act
2-11 for each day spent in performing the member's official duties, and
2-12 to reimbursement for expenses incurred in performing those duties
2-13 to the extent permitted by the General Appropriations Act.>
2-14 SECTION 3. The importance of this legislation and the
2-15 crowded condition of the calendars in both houses create an
2-16 emergency and an imperative public necessity that the
2-17 constitutional rule requiring bills to be read on three several
2-18 days in each house be suspended, and this rule is hereby suspended,
2-19 and that this Act take effect and be in force from and after its
2-20 passage, and it is so enacted.
