A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the adoption of municipal boundaries and annexation of
1-3 area.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 43.901, Texas Local Government Code, is
1-6 amended to read as follows:
1-7 (a) A municipal ordinance defining boundaries of or annexing
1-8 area to a municipality is conclusively presumed to have been
1-9 adopted in accordance with the requirements of this chapter <with
1-10 the consent of all appropriate persons> if:
1-11 (1) two years have expired after the date of the
1-12 adoption of the ordinance; and
1-13 (2) an action to annul or review the adoption of the
1-14 ordinance has not been initiated in that two-year period.
1-15 (b) This section does not validate governmental acts or
1-16 proceedings relating to a municipality's annexation or attempted
1-17 annexation, or the inclusion of territory on the official city
1-18 boundary map, which is in the extraterritorial jurisdiction of
1-19 another municipality, without the consent of that municipality.
1-20 SECTION 2. The importance of this legislation and the
1-21 crowded condition of the calendars in both houses create an
1-22 emergency and an imperative public necessity that the
1-23 constitutional rule requiring bills to be read on three several
2-1 days in each house be suspended, and this rule is hereby suspended,
2-2 and that this Act take effect and be in force from and after its
2-3 passage, and it is so enacted.
