   1-19                         A BILL TO BE ENTITLED
   1-20                                AN ACT
   1-21  relating to the regulation of diversion of water.
   1-22        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-23        SECTION 1.  Section 11.086, Water Code, is amended by adding
   1-24  Subsection (e) to read as follows:
   1-25        (e)  The prohibition of Subsection (a) of this section shall
   1-26  not be deemed to impose liability upon a municipality by reason of
   1-27  the acceptance of drainage or other improvements constructed by a
   1-28  developer and dedicated to the municipality in conjunction with
   1-29  subdivision platting or other development activity.
   1-30        SECTION 2.  The importance of this legislation and the
   1-31  crowded condition of the calendars in both houses create an
   1-32  emergency and an imperative public necessity that the
   1-33  constitutional rule requiring bills to be read on three several
   1-34  days in each house be suspended, and this rule is hereby suspended,
   1-35  and that this Act take effect and be in force from and after its
   1-36  passage, and it is so enacted.
