                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to The University of Texas at San Antonio and approval of
    1-3  new departments, schools, and programs.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 71.03, Education Code, is amended to read
    1-6  as follows:
    1-7        Sec. 71.03.  Courses and Degrees.  (a)  The board may
    1-8  prescribe courses leading to such customary degrees as are offered
    1-9  at leading American universities and may award those degrees.  It
   1-10  is the intent of the legislature that those degrees include
   1-11  bachelor's, master's, and doctor's degrees and their equivalents,
   1-12  and that there be established a standard four-year undergraduate
   1-13  program.
   1-14        (b)  A<; but no> department, school, or degree program may
   1-15  not be instituted except with the prior approval of the Texas
   1-16  Higher Education Coordinating Board<, Texas College and University
   1-17  System>.
   1-18        (c)  At a minimum, the board, in accordance with Section
   1-19  61.055(b) of this code, shall offer:
   1-20              (1)  baccalaureate programs in hospitality management;
   1-21  radio, television, and film; international relations;
   1-22  communications; graphic design; public administration; art history;
   1-23  philosophy; and Mexican American studies;
   1-24              (2)  master's programs in technology management,
    2-1  environmental geology, psychology, art history, sociology,
    2-2  political science, hospitality management, earth science education,
    2-3  urban studies, physics, regional planning, and criminal justice;
    2-4  and
    2-5              (3)  doctoral programs in computer science, education
    2-6  leadership, electrical engineering, mechanical engineering, civil
    2-7  engineering, and biology.
    2-8        (d)  The board, in accordance with Section 61.055(b) of this
    2-9  code,  shall cooperate with the board of regents of the Texas State
   2-10  University System to offer educational administration programs at
   2-11  the Alpine campus or the Uvalde Center of Sul Ross State
   2-12  University.
   2-13        (e)  Beginning with the fall semester in 1995, the board
   2-14  shall begin offering at least one-eighth of the courses and degrees
   2-15  required by this section.  Each academic year after the 1995-1996
   2-16  academic year, the board shall offer at least an additional
   2-17  one-eighth of the courses and degrees required by this section
   2-18  until all the courses and degrees required by this section are
   2-19  being offered.  This subsection expires January 1, 2004.
   2-20        SECTION 2.  Subchapter C, Chapter 65, Education Code, is
   2-21  amended by adding Section 65.47 to read as follows:
   2-22        Sec. 65.47.  ENHANCEMENTS FOR THE UNIVERSITY OF TEXAS AT SAN
   2-23  ANTONIO.  To the extent that funds are available for this purpose,
   2-24  the board shall provide to The University of Texas at San Antonio
   2-25  funding that is equal to or greater than the funding provided to
   2-26  The University of Texas at Austin for:
   2-27              (1)  student support services;
    3-1              (2)  faculty salaries;
    3-2              (3)  libraries;
    3-3              (4)  student scholarships;
    3-4              (5)  student and faculty research;
    3-5              (6)  instructional and laboratory equipment; and
    3-6              (7)  community outreach programs.
    3-7        SECTION 3.  Section 61.055, Education Code, is amended to
    3-8  read as follows:
    3-9        Sec. 61.055.  Initiation of New Departments, Schools, and
   3-10  Programs.  (a)  Except as provided by Subsection (b) of this
   3-11  section, a <No> new department, school, or degree or certificate
   3-12  program approved by the board or its predecessor, the Texas
   3-13  Commission on Higher Education, may not be initiated by any
   3-14  institution of higher education until the board has made a written
   3-15  finding that the department, school, or degree or certificate
   3-16  program is adequately financed by legislative appropriation, by
   3-17  funds allocated by the board, or by funds from other sources.
   3-18        (b)  The coordinating board shall make a determination for
   3-19  approval or disapproval of any department, school, or program that
   3-20  is required by other law not later than the 13th month for doctoral
   3-21  programs and the ninth month for departments, schools, and programs
   3-22  other than doctoral programs after the date a complete application
   3-23  is submitted to the coordinating board seeking approval of the
   3-24  department, school, or program.
   3-25        SECTION 4.  To the extent that funds are available for this
   3-26  purpose, the board of regents of The University of Texas System
   3-27  shall provide the funding required by Section 65.47, Education
    4-1  Code, as added by this Act, beginning the fiscal year beginning
    4-2  September 1, 1993.
    4-3        SECTION 5.  The importance of this legislation and the
    4-4  crowded condition of the calendars in both houses create an
    4-5  emergency and an imperative public necessity that the
    4-6  constitutional rule requiring bills to be read on three several
    4-7  days in each house be suspended, and this rule is hereby suspended,
    4-8  and that this Act take effect and be in force from and after its
    4-9  passage, and it is so enacted.
