                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the use of certain amounts in the state highway fund.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 5(b), Chapter 186, General Laws, Acts of
    1-5  the 39th Legislature, Regular Session, 1925 (Article 6674e,
    1-6  Vernon's Texas Civil Statutes), is amended to read as follows:
    1-7        (b)  Revenues that are not required by the Texas Constitution
    1-8  or Federal law to be spent for public roadways and that are
    1-9  deposited in the State Highway Fund may be appropriated for any
   1-10  function performed by the Texas Department of Transportation.  The
   1-11  Texas Department of Transportation shall use appropriations of
   1-12  revenues described by this subsection, to the extent permitted by
   1-13  the terms of the appropriations and by federal law, to acquire
   1-14  federal funds available under the Intermodal Surface Transportation
   1-15  Efficiency Act of 1991 (23 U.S.C. Section 133), including
   1-16  subsequent amendments to that Act, for the full range of
   1-17  permissible transportation enhancement activities, as defined in 23
   1-18  U.S.C. Section 101(a), including subsequent amendments of that
   1-19  definition.
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
