                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the authority of a winery to give away promotional
    1-3  bottles of wine.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter A, Chapter 102, Alcoholic Beverage
    1-6  Code, is amended by adding Section 102.19 to read as follows:
    1-7        Sec. 102.19.  PROMOTIONAL GIFT WINE.  A holder of a winery
    1-8  permit may give one or more unopened bottles of Texas-made wine
    1-9  produced or bottled by the winery to a person 21 years of age or
   1-10  older on the premises of a convention center or civic center that
   1-11  holds a mixed beverage permit if no charge is made by the winery or
   1-12  by the mixed beverage permittee for the wine.    A recipient of a
   1-13  bottle  of wine under this section must take the unopened gift
   1-14  bottle off the premises of the mixed beverage permittee.
   1-15        SECTION 2.  The importance of this legislation and the
   1-16  crowded condition of the calendars in both houses create an
   1-17  emergency and an imperative public necessity that the
   1-18  constitutional rule requiring bills to be read on three several
   1-19  days in each house be suspended, and this rule is hereby suspended,
   1-20  and that this Act take effect and be in force from and after its
   1-21  passage, and it is so enacted.
