                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the authority of a winery to give promotional bottles
    1-3  of wine to unlicensed persons in a civic center or convention
    1-4  center.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Section 102.19, Alcoholic Beverage Code, is
    1-7  amended by adding a new Section 102.19 to read as follows:
    1-8        Section 102.19.  PROMOTIONAL GIFT WINE IN A CIVIC CENTER.
    1-9  Nothing in this code shall prohibit the holder of a winery permit
   1-10  from giving one or more bottles of Texas-made wine produced or
   1-11  bottled by the winery to unlicensed persons of legal drinking age
   1-12  on the premises of a convention center or civic center at which a
   1-13  mixed beverage permit is held, provided that no charge of any sort
   1-14  is made by the winery or by the mixed beverage permittee for such
   1-15  gift.  Under such circumstances, the recipient may take the
   1-16  unopened gift bottle off the premises of the mixed beverage
   1-17  permittee.
   1-18        SECTION 2.  EMERGENCY CLAUSE.    The importance of this
   1-19  legislation and the crowded condition of the calendars in both
   1-20  houses create an emergency and an imperative public necessity that
   1-21  the constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended,
   1-23  and that this Act take effect and be in force according to its
    2-1  terms, and it is so enacted.
