   1-21                         A BILL TO BE ENTITLED
   1-22                                AN ACT
   1-23  relating to the authority of a winery to give away promotional
   1-24  bottles of wine.
   1-25        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-26        SECTION 1.  Subchapter A, Chapter 102, Alcoholic Beverage
   1-27  Code, is amended by adding Section 102.19 to read as follows:
   1-28        Sec. 102.19.  PROMOTIONAL GIFT WINE.  A holder of a winery
   1-29  permit may give one or more unopened bottles of Texas-made wine
   1-30  produced or bottled by the winery to a person 21 years of age or
   1-31  older on the premises of a convention center or civic center that
   1-32  holds a mixed beverage permit if no charge is made by the winery or
   1-33  by the mixed beverage permittee for the wine.    A recipient of a
   1-34  bottle  of wine under this section must take the unopened gift
   1-35  bottle off the premises of the mixed beverage permittee.
   1-36        SECTION 2.  The importance of this legislation and the
   1-37  crowded condition of the calendars in both houses create an
   1-38  emergency and an imperative public necessity that the
   1-39  constitutional rule requiring bills to be read on three several
   1-40  days in each house be suspended, and this rule is hereby suspended,
   1-41  and that this Act take effect and be in force from and after its
   1-42  passage, and it is so enacted.
