A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to The University of Texas--Pan American and approval of
1-3 new departments, schools, and programs and changing its name to The
1-4 University of Texas--Pan American at Edinburg.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Section 77.12, Education Code, is amended by
1-7 adding Subsections (d), (e), and (f) to read as follows:
1-8 (d) At a minimum, the board shall, in accordance with
1-9 Section 61.055(b) of this code, offer:
1-10 (1) baccalaureate programs in nursing, physical
1-11 therapy, health care administration, medical records
1-12 administration, occupational therapy, mechanical engineering,
1-13 electrical engineering, industrial engineering, civil engineering,
1-14 international business, deaf education, French, Mexican American
1-15 studies, environmental sciences, premedical studies, and
1-16 prepharmacy studies;
1-17 (2) master's programs in sociology, social work, art,
1-18 accounting, psychology, anthropology, mathematics, library science,
1-19 Mexican American studies, nurse midwifery, and nurse practitioner
1-20 studies; and
1-21 (3) doctoral programs in business, educational
1-22 administration, public administration, educational psychology,
1-23 biology, biochemistry, Spanish, and English.
1-24 (e) The board shall provide engineering courses in Cameron
2-1 County as the board determines necessary to support industrial
2-2 growth in that county.
2-3 (f) Beginning with the fall semester in 1995, the board
2-4 shall begin offering at least one-eighth of the courses and degrees
2-5 required by this section. Each academic year after the 1995-1996
2-6 academic year, the board shall offer at least an additional
2-7 one-eighth of the courses and degrees required by this section
2-8 until all of the courses and degrees required by this section are
2-9 being offered. This subsection expires January 1, 2004.
2-10 SECTION 2. Subchapter C, Chapter 65, Education Code, is
2-11 amended by adding Section 65.47 to read as follows:
2-12 Sec. 65.47. ENHANCEMENTS FOR THE UNIVERSITY OF TEXAS--PAN
2-13 AMERICAN. To the extent that funds are available for this purpose,
2-14 the board shall provide to The University of Texas--Pan American at
2-15 Edinburg funding that is equal to or greater than the funding
2-16 provided to The University of Texas at Austin for:
2-17 (1) student support services;
2-18 (2) faculty salaries;
2-19 (3) libraries;
2-20 (4) student scholarships;
2-21 (5) student and faculty research;
2-22 (6) instructional and laboratory equipment; and
2-23 (7) community outreach programs.
2-24 SECTION 3. Section 51.502(1), Education Code, is amended to
2-25 read as follows:
2-26 (1) "Eligible institution" means the college,
2-27 department, or other unit of engineering at any of the following
3-1 institutions of higher education:
3-2 (A) The University of Texas at Austin;
3-3 (B) The University of Texas at Arlington;
3-4 (C) The University of Texas at El Paso;
3-5 (D) The University of Texas at San Antonio;
3-6 (E) The University of Texas of the Permian
3-7 Basin;
3-8 (F) Texas A&M University;
3-9 (G) Prairie View A&M University;
3-10 (H) Texas Tech University;
3-11 (I) Lamar University;
3-12 (J) University of Houston; <and>
3-13 (K) Texas A&M <A&I> University--Kingsville; and
3-14 (L) The University of Texas--Pan American at
3-15 Edinburg.
3-16 SECTION 4. Section 61.003(3), Education Code, is amended to
3-17 read as follows:
3-18 (3) "General academic teaching institution" means The
3-19 University of Texas at Austin; The University of Texas at El Paso;
3-20 The University of Texas of the Permian Basin; The University of
3-21 Texas at Dallas; The University of Texas at San Antonio; Texas A&M
3-22 University, Main University; The University of Texas at Arlington;
3-23 Tarleton State College; Prairie View Agricultural and Mechanical
3-24 College; Texas Maritime Academy; Texas Tech University; University
3-25 of North Texas; Lamar University; Texas A&M <A&I>
3-26 University--Kingsville; Texas Woman's University; Texas Southern
3-27 University; Midwestern University; University of Houston; The
4-1 University of Texas--Pan American at Edinburg <University>; The

4-8 this chapter or created and so classified, expressly or impliedly,
4-9 by law.
4-10 SECTION 5. Section 61.055, Education Code, is amended to
4-11 read as follows:
4-12 Sec. 61.055. Initiation of New Departments, Schools, and
4-13 Programs. (a) Except as provided by Subsection (b) of this
4-14 section, a <No> new department, school, or degree or certificate
4-15 program approved by the board or its predecessor, the Texas
4-16 Commission on Higher Education, may not be initiated by any
4-17 institution of higher education until the board has made a written
4-18 finding that the department, school, or degree or certificate
4-19 program is adequately financed by legislative appropriation, by
4-20 funds allocated by the board, or by funds from other sources.
4-21 (b) The coordinating board, in accordance with its rules,
4-22 shall make a determination for approval or disapproval of any
4-23 department, school, or program that is required by other law not
4-24 later than the 13th month for doctoral programs and the ninth month
4-25 for departments, schools, and programs other than doctoral programs
4-26 after the date a complete application is submitted to the
4-27 coordinating board seeking approval of the department, school, or
5-1 program.
5-2 SECTION 6. Section 77.01(2), Education Code, is amended to
5-3 read as follows:
5-4 (2) "University" means The University of Texas--Pan
5-5 American at Edinburg.
5-6 SECTION 7. Section 77.11, Education Code, is amended to read
5-7 as follows:
5-8 Sec. 77.11. The University of Texas--PAN AMERICAN AT
5-9 EDINBURG. The University of Texas--Pan American at Edinburg is a
5-10 coeducational institution of higher education located in the City
5-11 of Edinburg. The university is a component institution of The
5-12 University of Texas System under the governance, management, and
5-13 control of the Board of Regents of The University of Texas System.
5-14 SECTION 8. Section 77.13, Education Code, is amended to read
5-15 as follows:
5-16 Sec. 77.13. Gifts and Grants. The board may accept and
5-17 administer, on terms and conditions acceptable to it, gifts,
5-18 grants, or donations of any kind and from any source for use by The
5-19 University of Texas--Pan American at Edinburg.
5-20 SECTION 9. Section 55.172, Education Code, is amended to
5-21 read as follows:
5-22 Sec. 55.172. The University of Texas--Pan American AT
5-23 EDINBURG. (a) The board of regents of The University of Texas
5-24 System may construct and equip academic buildings, structures, and
5-25 facilities for The University of Texas--Pan American at Edinburg,
5-26 following approval for such construction by the Texas Higher
5-27 Education Coordinating Board and for these purposes may issue
6-1 revenue bonds pursuant to this subchapter. The board may pledge
6-2 irrevocably to the payment of these revenue bonds all or any part
6-3 of the aggregate amount of student tuition charges required or
6-4 authorized by law to be imposed on students enrolled at The
6-5 University of Texas--Pan American at Edinburg; and the amount of
6-6 any pledge so made shall never be reduced or abrogated while the
6-7 bonds are outstanding. However, the tuition charges shall not be
6-8 pledged pursuant to the authority granted by this subsection except
6-9 to the payment of bonds issued in an aggregate principal amount not
6-10 to exceed $10 million for the purpose of providing funds to
6-11 construct and equip academic buildings, structures, and facilities
6-12 for The University of Texas--Pan American at Edinburg.
6-13 (b) It is provided, however, that no bonds shall be issued
6-14 hereunder and no tuition shall be pledged thereto unless and until
6-15 the specific terms and provisions of said bonds and pledge have
6-16 been first approved by the Texas Higher Education Coordinating
6-17 Board in accordance with rules and regulations regarding that
6-18 subject adopted, published, and heard in accordance with Section
6-19 61.027 of this code.
6-20 SECTION 10. Section 12.1105(e), Parks and Wildlife Code, is
6-21 amended to read as follows:
6-22 (e) The Parks and Wildlife Department, when requested by
6-23 authorized representatives of units of The University of Texas
6-24 System, The Texas A&M University System, the Texas A&I University
6-25 System, The University of Texas--Pan American at Edinburg <Pan
6-26 American University>, the Lamar University System, and Southwest
6-27 Texas State University, engaged in teaching and research related to
7-1 marine science and oceanography, may transfer to such units of said
7-2 universities and university systems nets, seines, and other marine
7-3 equipment, which have been seized under this section, to be used in
7-4 carrying out the teaching and research programs within said
7-5 institutions.
7-6 SECTION 11. Section 2(5)(A), Chapter 421, Acts of the 63rd
7-7 Legislature, Regular Session, 1973 (Article 6252-9b, Vernon's Texas
7-8 Civil Statutes), is amended to read as follows:
7-9 (A) "Appointed officer of a major state agency"
7-10 means any of the following:
7-11 (i) a member of the Public Utility
7-12 Commission of Texas;
7-13 (ii) a member of the Texas Department of
7-14 Commerce;
7-15 (iii) a member of the Texas Board of
7-16 Aviation;
7-17 (iv) a member of the Texas Air Control
7-18 Board;

12-4 SECTION 12. (a) The name of The University of Texas--Pan
12-5 American is changed to The University of Texas--Pan American at
12-6 Edinburg.
12-7 (b) A reference in law to The University of Texas--Pan
12-8 American means The University of Texas--Pan American at Edinburg.
12-9 (c) An appropriation for the use and benefit of The
12-10 University of Texas--Pan American is available for the use and
12-11 benefit of The University of Texas--Pan American at Edinburg.
12-12 (d) Before using new stationery or other supplies printed
12-13 with the institution's name as changed by this Act, the institution
12-14 shall use all stationery and other supplies that are printed with
12-15 the institution's former name and are in its possession on the
12-16 effective date of this Act.
12-17 SECTION 13. To the extent that funds are available for this
12-18 purpose, the board of regents of The University of Texas System
12-19 shall provide the funding required by Section 65.47, Education
12-20 Code, as added by this Act, beginning with the fiscal year
12-21 beginning September 1, 1993.
12-22 SECTION 14. The importance of this legislation and the
12-23 crowded condition of the calendars in both houses create an
12-24 emergency and an imperative public necessity that the
12-25 constitutional rule requiring bills to be read on three several
12-26 days in each house be suspended, and this rule is hereby suspended,
12-27 and that this Act take effect and be in force from and after its
13-1 passage, and it is so enacted.
