A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to The University of Texas--Pan American and approval of
1-3 new departments, schools, and programs.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 77.12, Education Code, is amended by
1-6 adding Subsections (d), (e), and (f) to read as follows:
1-7 (d) At a minimum, the board shall, in accordance with
1-8 Section 61.055(b) of this code, offer:
1-9 (1) baccalaureate programs in nursing, physical
1-10 therapy, health care administration, medical records
1-11 administration, occupational therapy, mechanical engineering,
1-12 electrical engineering, industrial engineering, civil engineering,
1-13 international business, deaf education, French, Mexican American
1-14 studies, environmental sciences, premedical studies, and
1-15 prepharmacy studies;
1-16 (2) master's programs in sociology, social work, art,
1-17 accounting, psychology, anthropology, mathematics, library science,
1-18 Mexican American studies, nurse midwifery, and nurse practitioner
1-19 studies; and
1-20 (3) doctoral programs in business, educational
1-21 administration, public administration, educational psychology,
1-22 biology, biochemistry, Spanish, and English.
1-23 (e) The board shall provide engineering courses in Cameron
1-24 County as the board determines necessary to support industrial
2-1 growth in that county.
2-2 (f) Beginning with the fall semester in 1995, the board
2-3 shall begin offering at least one-eighth of the courses and degrees
2-4 required by this section. Each academic year after the 1995-1996
2-5 academic year, the board shall offer at least an additional
2-6 one-eighth of the courses and degrees required by this section
2-7 until all of the courses and degrees required by this section are
2-8 being offered. This subsection expires January 1, 2004.
2-9 SECTION 2. Subchapter C, Chapter 65, Education Code, is
2-10 amended by adding Section 65.47 to read as follows:
2-11 Sec. 65.47. ENHANCEMENTS FOR THE UNIVERSITY OF TEXAS--PAN
2-12 AMERICAN. To the extent that funds are available for this purpose,
2-13 the board shall provide to The University of Texas--Pan American
2-14 funding that is equal to or greater than the funding provided to
2-15 The University of Texas at Austin for:
2-16 (1) student support services;
2-17 (2) faculty salaries;
2-18 (3) libraries;
2-19 (4) student scholarships;
2-20 (5) student and faculty research;
2-21 (6) instructional and laboratory equipment; and
2-22 (7) community outreach programs.
2-23 SECTION 3. Section 51.502(1), Education Code, is amended to
2-24 read as follows:
2-25 (1) "Eligible institution" means the college,
2-26 department, or other unit of engineering at any of the following
2-27 institutions of higher education:
3-1 (A) The University of Texas at Austin;
3-2 (B) The University of Texas at Arlington;
3-3 (C) The University of Texas at El Paso;
3-4 (D) The University of Texas at San Antonio;
3-5 (E) The University of Texas of the Permian
3-6 Basin;
3-7 (F) Texas A&M University;
3-8 (G) Prairie View A&M University;
3-9 (H) Texas Tech University;
3-10 (I) Lamar University;
3-11 (J) University of Houston; <and>
3-12 (K) Texas A&M <A&I> University--Kingsville; and
3-13 (L) The University of Texas--Pan American.
3-14 SECTION 4. Section 61.003(3), Education Code, is amended to
3-15 read as follows:
3-16 (3) "General academic teaching institution" means The
3-17 University of Texas at Austin; The University of Texas at El Paso;
3-18 The University of Texas of the Permian Basin; The University of
3-19 Texas at Dallas; The University of Texas at San Antonio; Texas A&M
3-20 University, Main University; The University of Texas at Arlington;
3-21 Tarleton State College; Prairie View Agricultural and Mechanical
3-22 College; Texas Maritime Academy; Texas Tech University; University
3-23 of North Texas; Lamar University; Texas A&M <A&I>
3-24 University--Kingsville; Texas Woman's University; Texas Southern
3-25 University; Midwestern University; University of Houston; The
3-26 University of Texas--Pan American <University>; The University of
3-27 Texas at Brownsville; East Texas State University; Sam Houston
4-1 State University; Southwest Texas State University; West Texas A&M
4-2 <State> University; Stephen F. Austin State University; Sul Ross
4-3 State University; Angelo State University; The University of Texas
4-4 at Tyler <State College>; and any other college, university, or
4-5 institution so classified as provided in this chapter or created
4-6 and so classified, expressly or impliedly, by law.
4-7 SECTION 5. Section 61.055, Education Code, is amended to
4-8 read as follows:
4-9 Sec. 61.055. Initiation of New Departments, Schools, and
4-10 Programs. (a) Except as provided by Subsection (b) of this
4-11 section, a <No> new department, school, or degree or certificate
4-12 program approved by the board or its predecessor, the Texas
4-13 Commission on Higher Education, may not be initiated by any
4-14 institution of higher education until the board has made a written
4-15 finding that the department, school, or degree or certificate
4-16 program is adequately financed by legislative appropriation, by
4-17 funds allocated by the board, or by funds from other sources.
4-18 (b) The coordinating board shall make a determination for
4-19 approval or disapproval of any department, school, or program that
4-20 is required by other law not later than the 13th month for doctoral
4-21 programs and the ninth month for departments, schools, and programs
4-22 other than doctoral programs after the date a complete application
4-23 is submitted to the coordinating board seeking approval of the
4-24 department, school, or program.
4-25 SECTION 6. To the extent that funds are available for this
4-26 purpose, the board of regents of The University of Texas System
4-27 shall provide the funding required by Section 65.47, Education
5-1 Code, as added by this Act, beginning with the fiscal year
5-2 beginning September 1, 1993.
5-3 SECTION 7. The importance of this legislation and the
5-4 crowded condition of the calendars in both houses create an
5-5 emergency and an imperative public necessity that the
5-6 constitutional rule requiring bills to be read on three several
5-7 days in each house be suspended, and this rule is hereby suspended,
5-8 and that this Act take effect and be in force from and after its
5-9 passage, and it is so enacted.
