73R7706 E By Gray H.B. No. 2111 Substitute the following for H.B. No. 2111: By Hamric C.S.H.B. No. 2111 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the disposition of money in an inmate trust fund. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Section 501.014, Government Code, is amended by 1-5 adding Subsection (e) to read as follows: 1-6 (e) On notification by a court, the director of the 1-7 institutional division shall withdraw from an inmate's trust fund 1-8 any amount the inmate is ordered to pay by order of the court for 1-9 child support, restitution, fines, and court costs. The director 1-10 shall make a payment under this subsection as ordered by the court 1-11 to either the court or the party specified in the court order. The 1-12 director, the institutional division, and the department are not 1-13 liable for withdrawing or failing to withdraw money or making 1-14 payments or failing to make payments under this subsection. The 1-15 director shall make withdrawals and payments from an inmate's trust 1-16 fund under this subsection according to the following schedule of 1-17 priorities: 1-18 (1) as payment in full for all orders for child 1-19 support; 1-20 (2) as payment in full for all orders for restitution; 1-21 (3) as payment in full for all orders for fines; and 1-22 (4) as payment in full for all orders for court costs. 1-23 SECTION 2. This Act takes effect September 1, 1993. 1-24 SECTION 3. The importance of this legislation and the 2-1 crowded condition of the calendars in both houses create an 2-2 emergency and an imperative public necessity that the 2-3 constitutional rule requiring bills to be read on three several 2-4 days in each house be suspended, and this rule is hereby suspended.
