                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the regulation of residential leases of mobile home
    1-3  park sites.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Occupancy of a space in a mobile home park may
    1-6  not begin without a written lease agreement.
    1-7        SECTION 2.  A landlord renting a space in a mobile home park
    1-8  may not terminate the lease of the space without first sending the
    1-9  tenant a written notice to quit and allowing the tenant not less
   1-10  than 30 days to remove a tenant-owned mobile home from the space.
   1-11        SECTION 3.  A landlord may terminate a lease under this Act
   1-12  only if:
   1-13              (1)  the tenant fails to comply with local ordinances
   1-14  and state laws and rules relating to mobile homes; or
   1-15              (2)  the mobile home park site is condemned.
   1-16        SECTION 4.  The owner of a mobile home park may not refuse to
   1-17  lease sites to tenants who have purchased mobile homes from a
   1-18  seller other than a seller designated by the owner.  The owner of a
   1-19  mobile home park may not require a tenant selling a mobile home to
   1-20  pay a transfer fee to the owner.
   1-21        SECTION 5.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended,
    2-2  and that this Act take effect and be in force from and after its
    2-3  passage, and it is so enacted.
